The Lao Dong Newspaper Legal Consulting Office replied:
Article 3 of Decree 281/2025/ND-CP (effective from January 1, 2026) stipulates the regime and policies for individuals on the payroll of teams searching for and collecting martyrs' remains as follows:
Subjects specified in Clause 1, Article 2 of this Decree, during their time performing the task of searching for and collecting martyrs' remains, in addition to the salary, allowance and regimes according to current regulations, will also enjoy the following regimes and policies:
1. The monthly responsibility allowance is 0.5 times the basic salary according to the Government's regulations at the time of implementing the regime for salary recipients and is compared to the second-class military allowance for non-commissioned officers and soldiers.
The duration of the period of enjoyment is from the actual month of performing the task of searching and collecting martyrs' remains to the month of completing the task according to the plan for searching and collecting martyrs' remains of competent authorities.
2. The special monthly allowance is equal to 20% of the salary according to the current military rank or type, group, or grade plus the leadership position allowance, seniority allowance beyond the framework (if any) for those who are currently receiving salaries or military rank allowances for non-commissioned officers and soldiers on domestic duty; equal to 100% of the salary according to the current military rank or type, group, or grade plus the leadership position allowance, seniority allowance beyond the framework (if any) for those who are currently receiving salaries or military rank allowances for non-commissioned officers and soldiers on foreign duty.
Special allowances are calculated monthly, in cases where they are not enough months, they are implemented as follows: From 15 days or more, the allowance is calculated as 01 month, less than 15 days are calculated as 1/2 month.
3. An additional allowance of 02 (twice) times the basic allowance for the basic allowance for non-commissioned officers and infantry soldiers/person/day on duty abroad, the additional allowance for meals is calculated from the date of departure to perform the task of searching and collecting martyrs' remains to the date of entry into the country; equal to 01 (one) times the basic allowance for non-commissioned officers and infantry soldiers/person/day on duty in the country, calculated according to the actual days of searching and collecting martyrs' remains according to the plan for searching and collecting martyrs' remains of the competent authority. The above additional food fee is included in the meal, not paid in cash.
4. Receive a compensation regime equal to 0.2 times the basic salary/person/day calculated based on the actual days of performing the task of surveying, verifying information, organizing activities to search for and collect martyrs' remains (including time for mobilizing forces). During the actual working day, if working less than 04 hours is counted as 1/2 day, from 04 hours or more is counted as 01 day. When receiving the above compensation regime, they will not receive the work fee regime.
5. To be granted specialized clothes made of in-kind as prescribed in Appendix I issued with this Decree.
6. Health benefits of VND1,500,000/person (no more than 02 times/year) are calculated as follows: Time spent on the task of searching and collecting martyrs' remains (including time spent searching and collecting martyrs' remains at home and abroad; if interrupted, it will be accumulated) from 06 months to 12 months will be compensated 02 (twice); less than 06 months will be compensated 01 (one) time; when the Government adjusts to increase the basic salary, the compensation level prescribed in this clause will be adjusted to increase according to the rate of increase in the basic salary.
7. Captain, Political Commissar, Deputy Captain, Deputy Political Commissar of the teams searching and collecting martyrs' remains will be supported with a phone bill of VND 200,000/month; when the Government adjusts to increase the basic salary, the support level prescribed in this clause will be adjusted to increase according to the rate of increase in the basic salary.
Thus, people on the payroll of the search and collection teams for martyrs' remains are entitled to the regime and policies according to the above regulations.
