According to Lao Dong Newspaper's investigation, Decree No. 282/2025/ND-CP of the Government stipulating penalties for administrative violations in the fields of security, order, social safety; prevention and combat of social evils; prevention and combat of domestic violence has stated regulations related to penalties for acts of appropriating common property of the family or private property of other family members.
Article 43 states the content of violations of regulations on care, nurturing, and alimony:
1. A fine of between VND 5,000,000,000 and VND 10,000,000,000 shall be imposed for one of the following acts:
Refusing or evading alimony obligations between husband and wife after divorce; refusing or evading alimony obligations between siblings, between paternal grandparents, maternal grandparents and grandchildren according to the provisions of law;
Refusing or evading the obligation to support and raise parents; the obligation to support and care for children after divorce according to the provisions of law.
Remedial measures:
Forced to fulfill the obligation to contribute and nurture according to regulations for violations specified in Clause 1 of this Article.
Article 44 states economic violence:
1. A fine of between VND 20,000,000 and VND 30,000,000 shall be imposed for one of the following acts:
a) Appropriating common property of the family or private property of other family members;
b) Destroying the common property of the family or the private property of other family members but not to the extent of criminal prosecution;
c) Forcing family members to overwork;
d) Forcing family members to contribute financially beyond their ability;
e) Controlling assets and income of family members to create a state of material, spiritual or other dependence.
Remedial measures:
Forced to restore the original state for violations specified in point b, clause 1 of this Article, unless the property cannot be restored to its original state;
Forcing the return of property illegally occupied or forcing the return of money equal to the value of property obtained from illegally occupied that has been consumed, disposed of, or destroyed in violation of the law to the legal owner for acts violating the provisions of points a, d and d, clause 1 of this Article.
Article 45 states the act of forcing family members to leave their legal residence illegally:
1. A fine of between VND 5,000,000,000 and VND 10,000,000,000 shall be imposed for the act of forcing family members to leave their legal residence illegally, except for the cases specified in Clauses 2 and 3 of this Article.
2. A fine of between 10,000,000 VND and 20,000,000 VND shall be imposed for the act of threatening to infringe upon health and life to force family members to leave their legal residence illegally.
3. A fine of between VND 20,000,000 and VND 30,000,000 shall be imposed for the act of using tools, means or other objects to injure family members to force family members to leave their legal residence illegally.
