Conditions for granting an electricity operation license from February 2025

The Lao Dong Newspaper Legal Consulting Office replied:

Article 31 of the Electricity Law 2024 (effective from February 1, 2025) stipulates the conditions for granting electricity operation licenses as follows:

1. Organizations granted a power operation license must meet the following conditions:

a) To be legally established in accordance with the provisions of law;

b) Having a team of technical managers, business managers and a team directly involved in operations that meet the quantity and professional and technical conditions.

2. For the fields of power generation, power transmission, power distribution, organizations granted power operation licenses must meet the conditions specified in Clause 1 of this Article and the following conditions:

a) Having items of power generation, transmission, and power distribution works in accordance with the power development plan, power supply network development plan in the provincial planning, power development plan, and provincial planning implementation plan, including content on power supply network development plan and adjustment decisions (if any); being built and installed according to the approved design, meeting the conditions for putting the project into operation and use;

b) There are projects and works of power generation, transmission, and distribution that are built and installed in compliance with the provisions of the law on the sea, the law on land, the law on fire prevention, fire fighting and rescue, the law on environmental protection and other relevant legal provisions;

c) Having documents on safe management of dams and reservoirs according to the provisions of law for the field of hydropower plant generation.

3. For the field of wholesale and retail of electricity, licensed organizations must meet the conditions specified in Clause 1 of this Article and have a suitable plan for wholesale and retail of electricity.

4. The Government stipulates in detail the conditions for the fields of granting power operation licenses.

Thus, the conditions for granting a power operation license are stipulated as above.
