Pursuant to Clause 1, Article 20 of the 2019 Law on Militia and Self-Defense Forces, amended by Clause 9, Article 10 of the Law amending 11 Laws on Military and Defense 2025 (effective from July 1, 2025) stipulates as follows:
Military command committees at commune and village levels
1. The Commune-level Military Command is the standing agency for national defense work at the commune level. The members of the Commune-level Military Command include:
a) Commanders who are civil servants, members of the People's Committee at the commune level, reserve officers; in a state of national defense emergency, during war, called up to serve in the army according to the provisions of the Law on Officers of the Vietnam People's Army and continue to hold the position of Commander of the Commune-level Military Command;
b) Political Commissar appointed by the Secretary of the Commune-level Party Committee;
c) Deputy Political Commissar appointed by the Secretary of the Ho Chi Minh Communist Youth Union at the commune level;
d) Deputy Commander and Assistant are civil servants.
2. Commune-level military commands have their own headquarters or workplaces and are allowed to use their own seals according to the provisions of law.

Thus, from July 1, 2025, the regulations on the structure and composition of the Commune-level Military Command have points different from before as follows:
- Regulating that the commander is a civil servant (previously, according to Decree No. 33/2023/ND-CP, the commander was a commune-level civil servant. However, the relevant regulations on commune-level civil servants in this Decree are abolished from July 1, 2025.
- Deputy Commander and Assistant is a civil servant (before July 1, 2025, it was stipulated that: Deputy Commander is a non-professional person working at the commune level and has not yet held the position of Assistant to the Commune-level Military Command).
