Clause 2, Article 5 of Decree No. 33/2023/ND-CP stipulates as follows:
2. Commune-level civil servants specified in Clause 1, Article 2 of this Decree have the following titles:
a) Commander of the Military Command;
b) Office - statistics;
c) Land - construction - urban and environment (for wards and towns) or land - agriculture - construction and environment (for communes);
d) Finance - accounting;
d) Justice - civil status;
e) Culture - society.
Thus, before July 1, 2025, according to regulations, the Commander of the Commune-level Military Command is a commune-level civil servant.
However, relevant regulations on commune-level civil servants in Decree No. 33/2023/ND-CP are abolished by Clause 3, Article 71 of Decree 170/2025/ND-CP (effective from July 1, 2025).
Point a, Clause 1, Article 20 of the 2019 Law on Militia and Self-Defense Forces, amended by Point a, Clause 9, Article 10 of the Law amending 11 Laws on Military and Defense 2025 (effective from July 1, 2025) stipulates as follows:
The commander is a civil servant, member of the People's Committee at the commune level, reserve officer; in a state of national defense emergency, during war, called up to serve in the army according to the provisions of the Law on Officers of the Vietnam People's Army and continues to hold the position of Commander of the Commune-level Military Command;".
Thus, the regulations related to the Commander of the Commune-level Military Command change as above from July 1, 2025.
