Article 21 of the 2019 Law on Militia and Self-Defense Forces stipulates:
Military Command of agencies and organizations
1. The military command of an agency or organization is considered for establishment when the agency or organization meets the following conditions:
a) Having an organization of the Communist Party of Vietnam;
b) Having a self-defense unit of an agency or organization.
2. The military command of an agency or organization works under a concurrent regime, its composition includes the Commander who is the head or deputy head of the agency or organization, the Political Commissar who is the Secretary or Deputy Secretary of the Party Committee at the same level, the Deputy Commander, and the Deputy Political Commissar.
3. The military command of an agency or organization is allowed to use its own seal according to the provisions of law.
4. The military command of an agency or organization has the following functions and tasks:
a) Advising Party committees, heads of agencies and organizations in leading and directing national defense work;
b) Develop and organize the implementation of national defense work plans, self-defense work and other plans related to national defense and military tasks of agencies and organizations; coordinate the implementation of military rear policies and preferential policies for people with revolutionary contributions;
c) Organize military training, political and legal education, competitions, sports festivals, and exercises for self-defense; command self-defense to perform tasks according to the provisions of this Law, other relevant legal provisions and decisions of competent authorities;
d) Registration, management, preservation and use of weapons, military explosives, support tools, equipment, and technical means of self-defense units under their authority according to the provisions of law;
d) Advising Party committees and heads of agencies, organizing inspections, handling violations, handling complaints and denunciations, summarizing, emulation, and rewarding for defense work.
5. The Government shall prescribe the number of Deputy Commanders; standards and norms for working equipment of the Military Commands of agencies and organizations.
Accordingly, considering the establishment of a Military Command of an agency or organization when meeting the following conditions: Having an organization of the Communist Party of Vietnam; having a self-defense unit of an agency or organization.
