New regulations on temporary suspension of teaching for teachers

The Lao Dong Newspaper Legal Consulting Office replied:

Article 36 of the 2025 Law on Teachers (effective from January 1, 2026) stipulates the temporary suspension of teaching as follows:

1. Within the period of consideration and disciplinary action, the head of the educational institution decides to temporarily suspend teaching for teachers if the teacher's continued teaching can cause difficulties in consideration and disciplinary action or affect the reputation of the teacher and the psychology of the student; in case the head of the educational institution shows signs of violation, the competent authority shall appoint the head of the educational institution to make a decision to temporarily suspend teaching.

2. For teachers in public educational institutions, the period of temporary suspension of teaching and salary during the period of temporary suspension of teaching shall comply with the provisions of the law on civil servants and other relevant provisions of law.

3. For teachers in non-public educational institutions, the period of temporary suspension of teaching and salary during the period of temporary suspension of teaching shall comply with the provisions of the law on labor and other relevant provisions of law.

Thus, from January 1, 2026, the temporary suspension of teaching for teachers is regulated as above.
