Number of days off for parents on sick leave according to the new Social Insurance Law, applicable from July 1, 2025

The Lao Dong Newspaper Legal Consulting Office replied:

Article 44 of the Law on Social Insurance 2024 (effective from July 2025) stipulates the period of enjoying the regime when caring for sick children as follows:

1. The period of enjoying the sick child care regime for one year (from January 1 to December 31) for each child is a maximum of 20 days if the child is under 03 years old; a maximum of 15 days if the child is from 03 years old to under 07 years old.

2. In case both father and mother participate in compulsory social insurance, the period of enjoying the regime when caring for a sick child of each person shall be according to the provisions of Clause 1 of this Article.

3. The time off work to enjoy the regime when taking care of sick children as prescribed in this Article is counted according to working days not including holidays, Tet, and weekly days off.

Thus, from July 1, 2025, when children are sick, parents will have the above leave to take care of them.
