Which children receive monthly social assistance from the State?

Article 5 of Decree 20/2021/ND-CP stipulates the social protection beneficiaries receiving monthly social allowances as follows:

1. Children under 16 years old without a source of support are in one of the following cases:

a) Abandoned and not adopted;

b) Orphaned;

c) Orphaned of one parent and the remaining parent declared missing according to the provisions of law;

d) Orphaned of one parent and the remaining parent is receiving care and nurturing at a social assistance facility or social house;

d) Orphaned of one parent and the remaining parent is serving a prison sentence in a prison or is serving an administrative violation decision at a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility;

e) Both father and mother are declared missing according to the provisions of law;

g) Both father and mother are receiving care and nurturing benefits at social assistance facilities or social houses;

h) Both father and mother are serving a prison sentence in prison or are serving an administrative violation handling decision at a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility;

i) The father or mother is declared missing according to the provisions of law and the remaining parent is receiving care and nurturing at a social assistance facility or social house;

k) One parent is declared missing according to the provisions of law and the other parent is serving a prison sentence in a detention camp or is serving an administrative violation handling decision at a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility;

l) One parent is receiving care and nurturing benefits at a social assistance facility and the other parent is serving a prison sentence in a detention center or is serving an administrative violation handling decision at a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility.

2. People subject to the provisions of Clause 1 of this Article who are receiving monthly social allowances and are 16 years old but are studying culture, vocational training, professional secondary school, college, or first-degree university will continue to receive social assistance policies until they finish their studies, but not exceeding 22 years old.

3. Children infected with HIV/AIDS from poor households.

Thus, the above children will receive monthly social subsidies from the State.
