Talking to reporters on April 12, musician Hamlet Truong said that he had never been contacted by the crew of the program "Tu tinh phuong Nam 4" and Hong Loan, Bum Bum to ask for permission to use the song "Lanh cung", even though the performance was performed on a ticket-selling night.
According to musician Hamlet Truong, he did not know his song would appear in the program until information spread that the organizing unit of the program "Tu Tinh Phuong Nam 4" was fined for performing another performance illegally.
The organizers and Hong Loan, Bum Bum... have never called or contacted me to ask for permission," he said.
The male musician said that the song "Lanh cung" has been registered for copyright protection at the Vietnam Center for Protection of Music Copyright (VCPMC). Therefore, in principle, in addition to him, any unit that wants to use the song can go through the center to carry out procedures to apply for permission and pay fees.
When reporters contacted, VCPMC responded: "We will answer this issue with the composer. If the composer has questions or complaints, we will answer them.
After that, musician Hamlet Truong said that he had directly worked again with VCPMC and received information from the center that the unit "Tu tinh phuong Nam 4" had contacted the center to ask about the use of the song "Lanh cung", but the procedures had not yet been completed.
The male musician added that this means that the organizers have only stopped at asking for information, have not signed copyright agreements and have not paid for song usage fees.
If the procedures are not completed, it is not enough conditions to put the work on stage, especially for programs with ticket sales.
Notably, the performance using the song "Lanh cung" in the program "Tu tinh phuong Nam 4" also caused controversy on social networks. Many viewers were upset because the performance of Hong Loan, Bum Bum, Hong Ni was a performance using pre-recorded music. All three only lip-synced to perform, but the program charged a fee for viewers.
Regarding the program "Tu Tinh Phuong Nam 4", the Ho Chi Minh City Department of Culture and Sports issued a decision to sanction the organizing unit for violations in performance activities. Specifically, the program was determined to have organized performances that were not in accordance with the licensed content, when allowing the performance of additional performances outside the approved list.
According to management agencies, the act of arbitrarily adding performance content, especially in programs with ticket sales, is an act of violating regulations on organizing performing arts. In addition to administrative penalties, the organizing unit is also required to rectify the content control process, ensuring compliance with the registered dossier.
This move is seen as a step to tighten management after a series of controversies related to performance quality, lip-syncing suspicion and copyright issues in the program.
