When I went to the Ward People's Committee to work, I was notified that there was no guiding document confirming and proving low-income people in urban areas like mine.
I would like to ask, is there any official dispatch guiding the Ward People's Committee to confirm the subjects for my case?
Regarding this content, the Department of Housing and Real Estate Market Management has the following opinions:
Clause 5, Article 76 of the 2023 Housing Law stipulates the beneficiaries of social housing support policies as follows: "5. Low-income people in urban areas".
On February 9, 2026, the Government issued Decree No. 54/2026/ND-CP (effective from the date of signing) on amending and supplementing a number of articles of Decrees in the field of housing and real estate business.
Accordingly, Article 33 amending and supplementing Article 30 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on development and management of social housing stipulates as follows:
In case the subject specified in Clause 5, Article 76 of the Housing Law does not have a labor contract, it must ensure income conditions as prescribed in Clause 1 of this Article and be certified by the commune-level police agency where they permanently reside or temporarily reside or where they currently reside.
Within 7 days from the date of receiving the request for confirmation, the commune-level police where the citizen is permanently residing or temporarily residing or the current residence at the time of the citizen's request, are responsible for confirming the following information:
Full name, middle name and name; Date, month, year of birth; gender; personal identification number; date, month, year of issuance of ID card/citizen ID card; permanent residence/temporary residence/current place of residence.
Citizens are responsible for declaring and committing to information on average monthly income. Commune-level police coordinate with relevant agencies in verifying and post-checking information on average monthly income of citizens for necessary cases.
The application form confirming the income conditions specified in this clause is also a document proving the beneficiaries of social housing support policies.
In Form No. 05 of the Appendix issued together with Circular No. 08/2026/TT-BXD dated February 15, 2026 of the Minister of Construction on amending and supplementing a number of articles of Circulars in the field of housing, specific guidance has been provided on documents proving subjects and income to be able to buy or rent social housing (applied to subjects specified in Clause 5, Article 76 of the Housing Law who do not have labor contracts and are not entitled to pensions paid by the Social Insurance agency).
