Mr. H.V. T in Phu Tho reflected that his company is applying for a general environmental permit for all of the company's projects (projects that have had environmental impact assessments before 2024) and for a new project under construction (which has been approved for environmental impact assessment by the Ministry since July 2024).
Mr. T asked, is the application for a general environmental permit for the entire company required to apply Clause 1, Article 4 of Circular No. 45/2024/TT-BTNMT and Circular No. 05/2025/TT-BTNMT, QCVN 19:2024/BTNMT, QCVN 14:2025/BTNMT or will the old QCVN still be applied?
The Ministry of Agriculture and Environment answers this issue as follows: Circular No. 45/2024/TT-BTNMT promulgating national technical regulations on industrial emissions takes effect from July 1, 2025, Circular No. 05/2025/TT-BTNMT promulgating national technical regulations on domestic wastewater and urban wastewater, concentrated residential areas takes effect from September 1, 2025.
Facilities that have been put into operation, investment projects that have had decisions approving the appraisal results of the environmental impact assessment report or have received complete and valid dossiers requesting appraisal of the environmental impact assessment report, issuance of environmental permits or environmental registration before the effective date of the above Circulars are allowed to continue to apply national environmental technical regulations on emissions and wastewater according to the corresponding types of production, business, and services and regulations of local authorities (including local environmental technical regulations on emissions) until the end of December 31, 2031.
