On the Government Portal, Mr. N.C.M. L asked, his company is preparing to start construction of a warehouse containing raw materials belonging to the class III industrial project item.
In the company, there are individuals with a second-class construction supervision capacity certificate.
Mr. L asked, is the investor like his company allowed to self-supervise the construction of the above project?
In Decree No. 06/2021/ND-CP, is it allowed for investors to have the right to self-supervise works when they have sufficient capacity as prescribed, so what is the capacity as prescribed in the above detail?
The Department of Economics - Construction Investment Management, Ministry of Construction answers this question as follows:
According to the provisions of point a, clause 1, Article 121 of the 2014 Construction Law, the investor has the right to "Effectively supervise the construction of works when they have sufficient conditions and capacity to supervise construction and be responsible for their supervision".
Therefore, the company has the right to self-supervise the construction of the project invested by itself.
Conditions for construction supervision consulting organizations are specified in Article 155 of this Law:
Article 155. Conditions of construction supervision consulting organizations, construction inspection
1. Have sufficient capacity conditions suitable for construction supervision work, construction inspection.
2. Individuals consulting and supervising construction works, construction inspection must have a practicing certificate suitable for the work performed".
