From July 1, 2025, the Government has abolished the issuance of construction activity certificates for organizations and businesses, but for individuals to be granted construction practice certificates, Appendix VI of Decree No. 175/2024/ND-CP still has some inadequacies and irrationalities that need to be amended to suit reality.

Before Decree No. 175/2024/ND-CP, they had to take the exam and obtain a certificate of professional practice in supervising the installation of equipment on the project with a validity period of 5 years, after which they had to return the dossier and retake the exam to be granted a certificate of professional practice in installing equipment on the new project.
Since Decree No. 175/2024/ND-CP took effect, these people submitted dossiers to be tested for practicing certificates at construction management agencies, and they received the answer that their training major is not in the list of Appendix VI of Decree No. 175/2024/ND-CP, so they are not allowed to receive dossiers and take the test for certificates, although the scores of their training majors include subjects on electrical systems, liquid mechanics, ventilation...
They have worked for 15-20 years in supervising the installation of equipment on projects with many projects from low-rise to high-rise buildings, factories with project levels from grade III to grade I that according to Decree No. 175/2024/ND-CP they are not newly granted, which is unreasonable and needs to be amended.
Why is it that the training major in water supply and drainage is granted a practicing certificate for supervising the installation of equipment in works, but the majors in mechanical engineering, fire prevention and fighting, and rescue and relief are not granted it?
After research, the Department of Economics - Construction Investment Management (Ministry of Construction) has the following opinions:
Professional qualifications and fields for issuing construction practice certificates for the field of construction supervision are specified in Appendix VI of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government.
Accordingly, in addition to the basis for training majors according to diplomas", the determination of training expertise is also based on the appropriate training expertise shown in the transcript/excerpt of the diploma in case the diploma does not clearly state the training major.
Currently, the National Assembly has passed the Law on Construction (amended), which stipulates the content on the conditions of capacity and experience of individuals participating in construction activities as detailed by the Government.
The Ministry of Construction will urgently advise and submit to the Government for promulgation of Decrees guiding the implementation of the Law. The content of citizens' comments will be studied and absorbed by the Ministry of Construction and included in the content of amendments and supplements (if there is sufficient basis) in the Decree replacing Decree No. 175/2024/ND-CP.
