Massive recruitment of workers despite prolonged social insurance payment delays
Lim KR Co., Ltd. (Que Vo Industrial Park, Phuong Lieu Ward, Bac Ninh Province), established on August 8, 2018 with the main business line being: manufacturing electronic components.
This enterprise is one of the units that delays and is slow to pay social insurance (BHXH), unemployment insurance (BHTN), and health insurance (BHYT) for a long time in Bac Ninh, with a large amount of money. However, recently, the company has been actively recruiting more workers.
On the morning of August 5, 2026, from a recruitment posting for Lim KR Co., Ltd., we contacted a person claiming to be an employee of this company.
My side is recruiting 30 workers to work in the factory. Do you want to be official or seasonal, when can you go through an interview?", the female employee asked.
Regarding work, this person said that he will work in the workshop with stages such as tape pasting, running the machine, and stamping.
One month has 2 weeks working day, 2 weeks working night. The basic salary is 5,061,000 VND for the first year. By the 2nd year it will be 5,350,000 VND. The company will work all day on Sunday, there will be Sundays with shift changes. If you work 2 weeks working day, 2 weeks working night, your total income will be from 15 - 17 million VND/month, including overtime pay. The company will pay social insurance for workers," the female employee said.
Transfer the file to the Police
Informing reporters of Lao Dong Newspaper on August 5, representatives of Bac Ninh Provincial Social Insurance said that on May 26, the unit organized a working session with Lim KR Co., Ltd. Attending the working session were representatives of: Department of Home Affairs, Economic Security Department, Provincial Police; Provincial Industrial Parks Management Board; Leaders of the Provincial Labor Federation.
Accordingly, by the end of April 2026, Lim KR Co., Ltd. is still late in paying social insurance with an amount of over 7.5 billion VND, equivalent to 52.5 months. This situation affects the rights of employees at the company related to pensions, death benefits, occupational accidents, sickness, maternity.
Representatives of the Economic Security Department, Bac Ninh Provincial Police said: for the unit's late payment amount, there may be 2 acts: one is an administrative violation of late payment of social insurance, unemployment insurance, and health insurance; two is the act of evading payment as prescribed in Article 216 of the Penal Code.
If the unit evades payment, it will be prosecuted under criminal law.
At the meeting, Lim KR Co., Ltd. committed to implementing the roadmap for paying late payment interest. The parties agreed to request the company to fully pay late payment interest for social insurance, unemployment insurance, and health insurance to the social insurance agency before June 30, 2026.
However, as of July 31, 2026, this company is still late in paying the amount of 6.76 billion VND of social insurance, unemployment insurance, and health insurance.
The Social Insurance Agency is coordinating with relevant sectors to conduct specialized inspections, make records of administrative violations for the act of late payment of social insurance, unemployment insurance, and health insurance for employees and impose administrative penalties; and transfer the dossier to the Police for handling according to the provisions of law," said a representative of Bac Ninh Provincial Social Insurance.
Persistent handling over the years
The situation of slow social insurance payment of Lim KR Co., Ltd. has been persistent for many years.
In October 2024, from the reflection of employees of Lim KR Co., Ltd. being late in paying social insurance, a reporter from Lao Dong Newspaper had a working session with Bac Ninh Provincial Social Insurance on this issue.
At that time, Bac Ninh Provincial Social Insurance said that LIM KR Co., Ltd. had been delaying and slow paying social insurance, health insurance, and unemployment insurance since March 2020.
On October 13, 2021, the People's Committee of Bac Ninh province decided to impose an administrative fine on LIM KR Co., Ltd. with a fine of 150 million VND, and at the same time forced it to retroactively pay the late payment amount and late payment interest according to regulations.
On November 4, 2021, LIM KR Co., Ltd. paid a fine of 150 million VND. As of November 26, 2021, the Company has paid 280 million VND, and the late payment amount is still more than 2.8 billion VND.
After that, Bac Ninh Provincial Social Insurance proposed that Bac Ninh Provincial Police initiate a criminal case for the act of not fully paying social insurance, unemployment insurance, and health insurance for employees of LIM KR Co., Ltd., and at the same time transfer all dossiers and documents to the Provincial Police.
However, because the 2014 Law on Social Insurance has not clearly defined and separated between late payment and evasion of social insurance contributions, it leads to difficulties in determining the nature of violations as well as applying corresponding sanctions, especially considering criminal liability.
By September 26, 2024, Bac Ninh Provincial Social Insurance had a tripartite working session with representatives of the Provincial Police and representatives of LIM KR Co., Ltd.
According to the working minutes, after October 11, 2024, the unit did not pay social insurance and health insurance for employees as prescribed, Bac Ninh Provincial Social Insurance continues to organize specialized inspections on social insurance and health insurance contributions; resolutely handle administrative violations according to the provisions of law. If the unit does not rectify, continue to send dossiers to the Police agency; coordinate with the bank to freeze the enterprise's account.
However, from then until now, the situation of late social insurance payment of LIM KR Co., Ltd. has continued, and has not been completely resolved.
Meanwhile, businesses are still recruiting new workers, raising questions about the ability to ensure social insurance obligations for both existing and new workers.
According to the latest updated data of Bac Ninh Provincial Social Insurance (as of the end of July 2026), there are 731 units in the province that have been late in paying social insurance, health insurance, and unemployment insurance for 3 months or more, with a total amount of over 168 billion VND.
According to the 2024 Law on Social Insurance (effective from July 1, 2025), the acts of late payment and evasion of social insurance have been specifically defined, creating a unified legal basis for applying administrative or criminal handling measures to violating businesses.
