There is a plan for enforcement
Lao Dong Newspaper has just published an article "unnatural construction of illegal constructions, violating forest land in Hanoi" reflecting on the situation of many illegal constructions still existing in Tien Xuan commune, Thach That district despite being punished by authorities for illegal construction.
After the article was published and discussed with a reporter from Lao Dong Newspaper, Mr. Nguyen Van Nghia - Vice Chairman of Tien Xuan Commune People's Committee said:
"Now we are determined to handle it. The first step is to determine which place is residential land and which place is not residential land. And if the construction exceeds the residential land area, it will be demolished" - Mr. Nguyen Van Nghia said.
The leader of Tien Xuan commune also said that the authorities have a plan for enforcement and are asking for opinions to dismantle the illegal constructions.
Investigation by Lao Dong reporter shows that on November 26, 2024, Tien Xuan Commune People's Committee drew up a record of administrative violations in the field of land against Ms. Vu Thi Minh Thu (born in 1979), for the act of: Using special-use forest land, protective forest land, and production forest land to other types of land without permission from a competent state agency.
Then on December 3, 2024, the People's Committee of Thach That district issued Decision No. 5620/QD-XPHC against Ms. Vu Thi Minh Thu for the act of: Organizing construction without a construction permit but according to regulations must have a construction permit for the construction of individual houses.
Scale of violations: Install 5 stilt houses with wooden column frames. The total area of the construction is 187m2, at plot number 111, map sheet number 24-d, village 6, Tien Xuan commune (according to the 2014 survey map, Tien Xuan commune is part of plot number 85, map sheet number 4 and part of plot number 01 of map sheet number 60).

After that, the authorities continued to issue documents notifying the implementation of self-dismantling measures (January 7, 2025) and a decision to enforce the demolition of the illegal construction (February 5, 2025).
However, after many months of the above instructions from the government, many violating works at the above address still exist and have not been completely handled.
At the same time, handling land disputes
The authorities of Tien Xuan commune also said that in addition to handling illegal construction violations at the above address, the locality also has to handle the issue of land disputes for the land in this area.
Accordingly, the government has just organized 2 mediations according to the content of the petition of Mr. Tran Quoc Tuan (born in 1967, residing in Thanh Xuan, Hanoi) on the proposal to resolve land disputes with Ms. Vu Thi Minh Thu and Ms. Bui Thi Thanh Hang.
The disputed area is plot No. 12, map sheet 24-D, Trai Moi hamlet, Tien Xuan commune, Thach That district.
According to Lao Dong reporter, this area is located near the land that has been fined by the authorities for violating construction order as previously reflected.
Sharing with Lao Dong reporter, Mr. Tran Quoc Tuan said that he had submitted a petition to the authorities to request intervention and investigation of property destruction, wall breaking, cutting down perennial crops, and land encroachment.
At the same time, Mr. Tuan proposed to suspend construction and request the demolition of illegal constructions, arbitrarily constructing works at plot No. 12, map sheet No. 24-D (Tien Xuan commune, Thach That district, Hanoi city).
Regarding the case, in November 2024, the Criminal Police Department (Ministry of Public Security) issued a notice of transferring the petition to the Chairman of the Hanoi People's Committee for consideration and settlement in accordance with the law.
Mr. Nguyen Van Nghia - Vice Chairman of Tien Xuan Commune People's Committee - said that according to the commune's authority, after receiving Mr. Tuan's request, the commune held 2 land dispute mediation conferences.
"However, the immediate results of mediation between the two sides are still not agreed" - Vice Chairman of Tien Xuan Commune People's Committee said.
The authorities have requested households to keep the land plot in its original state when the case has not been resolved by the competent state agency.
