The City People's Committee issued Decision No. 1359/QD-XPHC and Decision No. 1360/QD-XPHC dated September 5, 2025 to sanction administrative violations against organizations that violate regulations in the field of environmental protection.
The City People's Committee administratively sanctioned Thanh Cong II Paper Joint Stock Company, headquartered at Road No. 6, Hoa Khanh Industrial Park, Lien Chieu Ward, Da Nang City, for violations: discharging emissions containing common environmental parameters into the environment exceeding technical standards on waste by 1.1 times to less than 1.5 times in the case of an emission flow of 500m3/hour to less than 5,000m3/hour; no equipment, tools, areas, or warehouses for common industrial solid waste according to regulations.
The fine is 85 million VND. At the same time, it is necessary to implement measures to overcome environmental pollution according to regulations and report the results of overcoming the consequences of violations, as prescribed in Point a, Clause 8, Article 20 of Decree No. 45/2022/ND-CP dated July 7, 2022 of the Government regulating administrative sanctions for violations in the field of environmental protection.
Forced to pay the cost of measuring and analyzing emission samples with a total amount of 7.5 million VND according to the Payment Proposal of the Central Institute of Occupational Safety and Health and Environmental Protection prescribed in Point b, Clause 8, Article 20 of Decree No. 45/2022/ND-CP dated July 7, 2022 of the Government regulating administrative sanctions in the field of environmental protection.
The deadline for implementing remedial measures is 30 days, from the date of receipt of the Decision on administrative sanctions.
The City People's Committee requested Mr. Nguyen Thanh Duc, the legal representative of Thanh Cong II Paper Joint Stock Company, to strictly comply with this penalty decision. If Thanh Cong II Paper Joint Stock Company fails to voluntarily comply within the deadline, it will be forced to comply according to the provisions of law and for each day of late payment of fines, the violator or organization must pay an additional 0.05% of the total amount of unpaid fines.
Along with that, administrative sanctions were imposed on Enigma Company Limited, headquartered at Lot BII-1, Cho Lo Industrial Park, Chien Dan Commune, Da Nang City, for the following violations: not properly implementing one of the contents of the Environmental License under the licensing authority of the District People's Committee; not classifying hazardous waste according to codes, lists and levels of hazardous waste according to regulations.
The forms of penalty include: a fine of 35 million VND for the act of not implementing one of the contents of an Environmental License under the licensing authority of the District People's Committee; a fine of 90 million VND for the act of not determining hazardous waste according to the code, list and hazardous waste threshold as prescribed. The total fine is 125 million VND.
The City People's Committee requested Mr. Pham Cong Toan, the legal representative of Enigma Company Limited, to strictly comply with this penalty decision. If Enigma Company Limited fails to voluntarily comply within the deadline, it will be forced to comply according to the provisions of law. For each day of late payment of fines, the violator or organization must pay an additional 0.05% of the total amount of unpaid fines.
