In his opening speech, Minister of Justice Nguyen Hai Ninh emphasized that the conference was organized for the ministry to listen to opinions from localities, especially the shortcomings, problems and difficulties in organizing the 2-level local government model.
Recently, the Minister and Deputy Ministers of Justice directly visited a number of localities, inspected communes and wards, showing many shortcomings and limitations.
The Minister said that some legal regulations are still inadequate, not promptly guiding, amending and supplementing, including the judicial sector.
Therefore, at the conference, the Ministry of Justice listens, shares and promptly resolves problems of localities; contents beyond its authority or not eligible for immediate handling, the ministry will record and have instructions to resolve.
Regarding the proposals of localities on supporting hotlines and responding to local recommendations, the minister requested the Department of Judicial Administration to deploy on July 11 to submit all official dispatches and guidance documents for local recommendations and reflections to the National Law Portal so that commune-level cadres in 3,321 communes can access, look up, discuss and refer to and apply when handling work.
Also at the conference, Minister Nguyen Hai Ninh said that, following the direction of the Central Steering Committee on perfecting institutions and laws, the Ministry of Justice is preparing a preliminary assessment report on the feasibility of tasks that are decentralized, delegated authority, and determine authority to localities.
Currently, the Ministry of Justice has preliminarily divided it into 3 groups, the first group is a feasible group, meaning the locality can completely take on the task; the second group is a feasible group but needs to have conditions to ensure increased human resources, material conditions, and completion of administrative procedures; the third group is an unfeasible group.
In which, the minister said that the group of unfeasible tasks is very small, for example, the task of decentralizing to localities, according to the preliminary assessment of the Ministry of Justice, there are only 2 unfeasible tasks in the field of science and technology.
All other contents are basically feasible and some tasks are feasible, but it is necessary to strengthen the conditions for guarantee as in the field of civil status.
"The Central Steering Committee on perfecting institutions and laws also assigned the Government, specifically the Ministry of Home Affairs to coordinate with the Ministry of Justice after 2 months of the two-level local governments coming into operation, that is, by September 1, there must be an official report to see if the decentralization and delegation of power to the locality is feasible in practice or not so that it can be calculated" - the minister informed.
Currently, the Ministry of Justice has a program to coordinate with the Ministry of Home Affairs to inspect each locality to prepare a report.
Concluding the conference, Deputy Minister Mai Luong Khoi suggested that the units under the ministry coordinate and review the contents that the local Departments of Justice are still wondering to include in the National Law Portal as a handbook for advice and guidance for local officials; at the same time, deploy training to improve the capacity of commune-level judicial officials.
