The Ministry of Construction is soliciting comments on the Draft Decree regulating investment in construction and management of dry port exploitation. The Ministry will collect opinions until October 20, 2025.
One of the notable points about the procedure for announcing the opening of dry ports is stipulated in Article 15 of the draft as follows:
The investor must directly or via the postal system or via the online public service system send 01 set of documents to the Vietnam Maritime and Waterway Administration.
The dossier to announce the opening of dry ports includes:
Electronic copy or copy of the Decision approving the investment project to build a dry port approved by competent authorities in accordance with the provisions of law;
Copies or electronic copies of legal documents proving land use rights according to regulations;
cope or electronic copy of the Minutes of acceptance for completion of port facilities for use, accompanied by drawings of the completion site of the main works specified in Clause 2, Article 7 of this Decree;
Electronic copy or copy of the Decision approving the Environmental Impact Assessment Report of the Project according to regulations.
The dossier to announce the conversion of import and export customs clearance points to dry ports includes:
The dossier is as prescribed in Points a, c, d and dd, Clause 2 of this Article;
Electronic copy or copy of the Decision to recognize the customs procedure location of the competent authority.
The Vietnam Maritime and Waterway Administration receives the dossier. If the dossier is invalid, no later than 02 working days from the date of receipt of the dossier, the Vietnam Maritime and Waterway Administration must send a document to the investor via the postal system or via the online public service system stating the reasons and requirements for supplementing and completing the dossier according to the provisions of this Decree; if the dossier is valid, no later than 04 working days from the date of receipt of the complete dossier, the Vietnam Maritime and Waterway Administration shall appraise and issue a document requesting the Ministry of Construction to announce the opening of the dry port according to regulations.
Within 02 working days from the date of receipt of the document from the Vietnam Maritime and Waterway Administration, the Ministry of Construction decides to announce the opening of a dry port according to Form No. 03 prescribed in the Appendix issued with this Decree and send it via the postal system or via the online public service system to the investor; in case of non-agreement, there must be a written response to the investor stating the reason.
One of the new points of the draft compared to the old regulation is to allow units to submit documents via the online public service system. Accordingly, the documents are in electronic copies.
