The project has been sluggishly implemented for 18 years
Nhon Hoi Industrial Park Project (Area B) in Nhon Hoi Economic Zone (Binh Dinh) invested by Hong Yeung Vietnam One Member Co., Ltd. The legal representative is Mr. Tu Phong Boi (Xu Xie Feng Pei) - General Director.
In 2007, this company was granted the first Investment Certificate by the Nhon Hoi Economic Zone Management Board (now the Binh Dinh Economic Zone Management Board). By 2012, the certificate was adjusted to invest in the project of Investment in construction and business of infrastructure of Nhon Hoi Industrial Park (Area B), with an area of 447 hectares, with a total investment capital of more than 546 billion VND. According to the committed schedule, the project must complete the infrastructure according to the approved plan by the end of 2011.
However, up to now, this company has not completed the planning adjustment procedures and investment procedures according to regulations. Currently, the company has stopped construction and has not proven the actual construction volume arising since the recording of the minutes of the Economic Zone Management Board on April 23, 2021.
The company has not yet completed the procedures for reviewing and approving the construction drawing design documents, but has organized the leveling and implementation of some infrastructure items. At the same time, it has not provided relevant documents such as detailed design drawings, quality management documents, acceptance minutes, completion volume confirmation, completed drawings, payment invoices, etc., making it difficult to assess the quality and quantity of items.
Although the synchronous infrastructure has not been completed and the project has not been accepted, the company has leased the premises to a secondary unit in Nhon Hoi Industrial Park (Area B) which is not in accordance with regulations.
In May 2021, Hong Yeung Vietnam One Member Co., Ltd. proposed to extend the land use period in Nhon Hoi Industrial Park (Area B). After that, the Economic Zone Management Board issued a decision to extend the land use progress for 2 years, with the land rental amount of more than 60 billion VND.
After being extended and receiving the payment notice, this company submitted a petition to the Economic Zone Management Board, the Provincial People's Committee and was considered and responded to. However, the company did not agree, so it continued to file a lawsuit with the People's Court of Binh Dinh province. After acceptance and public trial, the Court rejected all the contents of the lawsuit of this company.
Ask for the opinion of the Ministry of Public Security to reclaim land
According to Vice Chairman of Binh Dinh Provincial People's Committee Nguyen Tu Cong Hoang, in 2022 and 2023, the Provincial People's Committee, the Economic Zone Management Board and related units have worked and urged many times, but the company still refuses to pay land rent and late payment fees to the State budget...
After reviewing and consolidating the dossier, the Department of Natural Resources and Environment submitted to the People's Committee of Binh Dinh province for consideration and issuance of a notice of land reclamation to Hong Yeung Vietnam One Member Co., Ltd. and related parties. The notice period is not more than 45 days from the date of issuance.
When the notice period expired, the Provincial People's Committee issued a decision to reclaim more than 400 hectares of land that the Economic Zone Management Board had leased to this company in 2009, to implement the Nhon Hoi Industrial Park project (Area B).
The reason for land reclamation is that the investor violated the 2024 Land Law. Of which, more than 84 hectares of land were leased by the State to implement the project but not used for 12 consecutive months from the date of handover; more than 320 hectares of land were leased by the State to implement the project but the land use progress was 24 months behind the commitment in the investment project.
"Because Hong Yeung Vietnam One Member Co., Ltd. has foreign factors and a long investment time, the People's Committee of Binh Dinh province proposed that the Ministry of Public Security consider and give opinions on the land recovery of Nhon Hoi Industrial Park project (Area B) due to violations of land laws, so that the province can organize and implement it" - Mr. Nguyen Tu Cong Hoang suggested.
