Implementing Resolution No. 1656/NQ-UBTVQH15 dated June 16, 2025 of the National Assembly Standing Committee on the arrangement of commune-level administrative units of Hanoi city in 2025 and the Law on Organization of Local Government (effective from July 1, 2025), Hanoi city will organize 2-level local government from July 1, 2025 (no longer at the district level).
The number of administrative procedure records at the commune level in Hanoi is currently very large (especially in the field of certification and civil status). According to the survey, from July 1 to 30, 2025, on average, a commune will receive and process 80-100 records related to certification and 20 records related to household registration per day.
To quickly resolve the transaction needs of people and organizations, and enhance the responsibility of commune-level civil servants in handling work, it is necessary to stipulate the administrative procedures authorized by the Chairman of the People's Committee at the commune level to civil servants under the People's Committee at the commune level...
Accordingly, the Resolution applies to subjects who are Chairmen of Commune People's Committees, civil servants under Commune People's Committees in Hanoi; organizations and individuals related to the contents of authorization for civil servants under Commune People's Committees in Hanoi.
Regarding the field of authorization, keep the 2 areas authorized as prescribed in Resolution No. 31/2024/NQ-HDND, including: justice and social protection.
In the judicial field, supplement the authorization content on certification of copies from the original of documents and papers issued or certified by competent foreign agencies and organizations; competent Vietnamese agencies and organizations in association with competent foreign agencies and organizations.
The reason for authorization is that according to the provisions of Clause 1, Article 1, Decree No. 07/2025/ND-CP dated January 9, 2025 of the Government on amending and supplementing a number of articles of decrees in the fields of civil status, nationality, certification, and authority of the People's Committee at the commune level is supplemented as follows: "The People's Committee of a commune, ward, or town has the authority and responsibility to: Certify the original copies of documents and papers issued or certified by a competent Vietnamese agency or organization; a competent foreign agency or organization of Vietnam associated with a competent foreign agency or organization".
The monthly support level for authorized civil servants is equal to 15% of the basic salary/person/month, similar to the support level stipulated in Resolution No. 31/2024/NQ-HDND.
Funding source for implementation: commune and ward budgets (in Resolution No. 31/2024/NQ-HDND, it is stipulated that the budget for districts, towns and cities is taken from the budget). Because the implementation of the two-level local government model (city and commune levels) is no longer at the district level, it is appropriate to determine the funding source for implementation from the commune and ward budgets.
