Decree 173/2025/ND-CP on contracts for performing duties of civil servants.

The process of signing a contract to perform duties of civil servants is based on Article 12 of Decree 173.

Article 12. Process of contract signing

After having a policy decision on allowing the signing of the contract, the head of the agency employing civil servants will take the following steps:

1. Notice of invitation to sign a contract in one of the following forms:

a) Post on electronic information portals or other mass media of agencies, organizations, and units (if any);

b) Directly send the invitation to sign the contract to the selected individual or organization;

c) The notice of invitation to sign a contract must include the following main contents:

Information on the tasks to be performed and the type of contract;

Conditions and standards of the subject of the contract;

Time and location of contract signing;

Expiry submitting documents and contact information for guidance, answers and receipt of documents (if any);

Other relevant contents according to the decision of the head of the agency employing civil servants.

2. Compile a list of registered individuals and organizations (for the cases specified in Point a, Clause 1 of this Article).

3. Report to competent authorities to sign a decision-making contract or decide according to their authority. In case there are many organizations and individuals who meet the requirements, a Consulting Council will be established to advise on the selection before deciding to sign the contract. The members of the Advisory Council and the methods of operation are according to the decision of the competent authority signing the contract.

4. Implement the signing of the contract.
