The Hanoi City Public Administration Service Center has just announced the Conclusion of a surprise inspection of the reception and settlement of administrative procedure records according to citizens' feedback and recommendations on administrative regulations at the Department of Construction.

Based on the system inspection, the content of statistical report on the implementation of all types of administrative records from January 1, 2024 to December 26, 2024 and probability inspection for 10 documents showed that, at the time of inspection on the system (January 13, 2025), the Department of Construction has not advised the City People's Committee on the issuance of the decision to announce the list of administrative procedures as prescribed.

In addition, there are many overdue records, in which the rate of overdue payment for resolved records is 27% (903 records/3337 records), especially in the field of construction materials, the rate of overdue payment is very high at 68% (101 records/148 records). 100% of overdue records do not have apology letters as prescribed in Clause 5, Article 12 and Clause 9, Article 19 of Decree No. 61/2018/ND-CP dated April 23, 2018 of the Government on implementing the one-stop, one-stop mechanism in handling administrative procedures.

The inspection team also pointed out that the Department of Construction is still short of the receipt and settlement of additional dossiers: The additional request for additional request and completion of the dossier is not consistent with the form issued together with Circular No. 01/2018/TT-VPCP dated November 23, 2018 of the Government Office guiding the implementation of a number of provisions of Decree No. 61/2018/ND-CP; The time for supplementing and completing the dossier is shorter than the time limit specified in the Minister of Construction's Decision No. 1105/QD-BXD of October 26, 2023 on the announcement of amended and supplemented administrative procedures; Replace in the field of construction activities within the scope of state management functions of the Ministry of Construction.

The Department of Construction also does not show on the process of submitting additional applications through the one -stop shop; Civil servants of the relevant departments have completed, ending the process steps on the information system for handling administrative procedures of the city before the date of payment, but the signing date of the results of administrative procedures settlement to return to organizations and individuals is overdue compared to the date of payment.

Many applications have not been attached to digitizing the results on the system (6 records /8 records - excluding 2 applications with withdrawal applications). For 2 applications with application for withdrawal, on the system and attached documents, it does not show the content of the Department of Construction's appraisal on the application's dossier from the date of submission to the date the unit has an application for withdrawing the dossier.

Responsibilities of relevant collectives and individuals

Regarding specific responsibilities, the inspection team stated that the Deputy Director of the Department of Construction under the field of assignment was not actively directing and urging the specialized agencies to advise and propose the competent authority to issue a decision to announce the list of administrative procedures as prescribed; Not closely, proactively directing and reviewing promptly on the settlement of administrative procedures slowly, late, not ensuring compliance with the process of handling administrative procedures, settling administrative procedures not in accordance with the regulations: Deputy Director of Mac Dinh Minh, Deputy Director of Literature, Deputy Director Nguyen The Cong.

Some collectives and individuals are directly responsible for handling administrative procedures late or late, not ensuring compliance with the process of handling administrative procedures, handling administrative procedure records in violation of regulations; for 10 inspection records directly related to collectives and individuals: Deputy Director of the Department of Construction of Van Phuong District; Construction Management Department, civil servants: Le Van Hung, Nguyen Tran Vinh Ha, Dang Anh Vu; Department of Construction licensing, civil servants Ha Ngoc Son; Department of Receiving and Returning Results, civil servants: Dang Anh Tuan, Nguyen Viet Hung.

The inspection team requested the Director of the Department of Construction to take measures to strengthen discipline and public service discipline. Review and seriously rectify management work, consider the responsibilities of individuals, units directly implementing and individuals, units involved in handling administrative procedures late and late, not ensuring compliance with the administrative procedure settlement process.

Strictly handle cases of handling administrative procedures that are not in accordance with regulations, including them in the criteria for scoring and evaluating civil servants' emulation on a monthly and annual basis. Apologizes to people and businesses when the settlement deadline is overdue according to regulations...

From there, the inspection team recommended that the Chairman of the City People's Committee assign the Director of the Department of Construction to urgently review and learn from the shortcomings and limitations in receiving and handling administrative procedures to promptly rectify and overcome the shortcomings and limitations;

Urgently direct the settlement of administrative procedure records to ensure compliance with regulations, ensuring the rights and interests of citizens and organizations. Direct the handling and settlement of administrative procedure records that are delayed or prolonged; implement apology to citizens and organizations in accordance with regulations. Direct the settlement of recommendations on administrative regulations to ensure compliance with regulations.
