Slow land ownership
According to the assessment of the Department of Natural Resources and Environment of Quang Nam, the progress of forest land ownership classification is very slow.
Up to now, only 33/85 communes in 9 mountainous districts have implemented the work of measuring, declaring and registering cadastral records, and issuing forestry land use right certificates (LCCs), with a measurement volume of more than 30,473 hectares (reaching 30.84%).
The Department of Natural Resources and Environment of Quang Nam has just approved cadastral map products for 10 communes; has declared, registered and granted forestry land use right certificates for about 9,369/57,046 records, reaching 16.42%.
In January 2021, the People's Council of Quang Nam issued Resolution No. 07, setting a target that by the end of the fourth quarter of 2021, localities will organize surveying, establish cadastral records, and issue forestry land use right certificates in 85 selected pilot communes. The total implementation cost is more than 114 billion VND.
Although Resolution 07/2021 is highly supported by the people, some localities are slow in implementing this Resolution, such as Hiep Duc district, which has only implemented it since the beginning of 2023, while Tien Phuoc district has shown signs of "outsourcing" to surveying consultants and related professional sectors.
According to a survey by the People's Committee of Hiep Duc district, there are 14,594 hectares that need to be measured and cadastral records established, while the technical design - estimate approved in Resolution 07 of the Provincial People's Council is only 812 hectares.
The reason is that the sectors and localities did not conduct thorough surveys, so the design and estimate were not close to reality, leading to the situation where the number of plots and areas measured increased significantly compared to the approved appraisal decision.
Be careful to ensure accuracy when measuring.
According to the People's Committee of Bac Tra My district, in September 2023, the district handed over 571 forestry land use right certificates to households in Tra Giac commune and has not yet issued any new certificates.
At meetings with voters, people all mentioned the implementation of Resolution 07. Therefore, specialized sectors need to focus on guiding localities to speed up the progress of granting forest land use right certificates in 9 mountainous districts; if they cannot do so, there will be a written response to inform the people - said the district leader.
According to Mr. Ha Duc Tien - Head of the Legal Committee of the Provincial People's Council, the obvious lesson for Quang Nam was when in the period of 2007 - 2011, the survey and issuance of forestry land use right certificates (LURCs) reached more than 65%; however, due to the high rate of errors in the documents, 9 mountainous districts could not issue them to the people. One district only issued 36 LURCs and kept thousands of them in the cabinet, not daring to issue them to the people for fear of disputes and lawsuits.
Faced with this situation, Quang Nam province pays special attention to the accuracy and reliability of measurement data in the communes where the project has been implemented, and gradually removes obstacles.
Recently, the People's Council of Quang Nam province has requested the Department of Natural Resources and Environment to continue reviewing, identifying shortcomings, clarifying the causes; from there, considering the need to amend and supplement Resolution 07 to suit reality, not stopping because of difficulties.
