According to the report dated January 16 of the Ha Tinh Department of Health, Decree No. 05 dated February 15, 2023 of the Government amending and supplementing a number of articles of Decree No. 56 dated July 4, 2011 stipulating the preferential allowance regime by profession for civil servants and public employees working at public health facilities.
Through review, Can Loc Medical Center is an autonomous unit (group 2), currently not implementing the payment of preferential allowance regimes as prescribed in Decree 05 of 2023 of the Government.
Reasons for late payment: According to the provisions of Decree No. 05 of 2023, allowances for subjects apply from January 1, 2022 to December 31, 2023. While self-sufficient units in group 2 of the additional allowance costs specified in this Decree have not been structured in the price of medical examination and treatment services, but are still waiting to be allocated from the state budget for the part of funding that is not self-guaranteed.
The process of implementing the Decree also has obstacles in professional guidance. On April 8, 2024, the Ministry of Finance issued Document No. 3666 to the Ministry of Health on the source of funding for implementing the professional preferential allowance regime according to Decree No. 05 of 2023 for public non-business units (classified as group 2).
On April 16, 2024, the Ministry of Health issued Document No. 1964 to the Departments of Health of provinces and centrally-run cities guiding implementation.
According to the guidance "In case the revenue of medical facilities from professional activities and other legal revenue sources of public financially self-sufficient medical facilities of group 2 does not ensure the payment of benefits, report to the level I estimating unit for appraisal, send to the same level financial agency to summarize the needs and funding sources for implementation".
However, during this period, Can Loc Medical Center has not implemented the payment of benefits according to the provisions of Decree No. 05 of 2023 because the unit's report to Can Loc District People's Committee (old) for appraisal and sending to the same-level financial agency has not been implemented.
On June 21, 2024, the Ministry of Finance issued document No. 6426 to the People's Committee of Ha Tinh province on the needs and funding sources for implementing salary reform in 2023 of Ha Tinh province.
In which, the content of the document of the Ministry of Finance that did not appraise more than 114.9 billion VND is the professional preferential allowance regime for public employees at public non-business establishments in Ha Tinh according to the provisions of Decree No. 05 of 2023, because these are public health facilities that have self-guaranteed regular expenses.
Also according to the Ha Tinh Department of Health, the difficulty for self-sufficient units is unstable revenue, the main source of revenue is from health insurance medical examination and treatment services. Some costs incurred in health insurance medical examination and treatment have not been liquidated and finalized in a timely manner such as: Expenses exceeding the ceiling, exceeding funds, exceeding estimates, exceeding bed days,... leading to difficulties in balancing funding sources to pay on time.
Currently, the Department of Health has issued a document directing the Heads of group 2 autonomous units (including Can Loc Medical Center) to use the unit's revenue, salary reform funds, and funds already set aside to pay benefits according to Decree No. 05 of 2023 for beneficiaries according to regulations, in order not to affect the rights of employees and generate lawsuits.
Previously, on January 14, Lao Dong Newspaper had an article reflecting that currently 138 officials, employees, and workers at Can Loc Medical Center have not received preferential allowances according to Decree No. 05 of 2023 of the Government. The incident affects their rights, so they have signed collective petitions sent to functional agencies.
