On the morning of April 29, at the 22nd session, the Hanoi People's Council approved the penalty level for a number of administrative violations in the field of environmental protection in Hanoi (implementing Clause 1, Article 33 of the Capital Law).
The subjects of application are domestic individuals, organizations and foreign individuals and organizations that commit administrative violations in the field of environmental protection as prescribed in Article 5 of this Resolution, except in cases where international treaties to which Vietnam is a member have other provisions. The competent person shall sanction administrative violations in the field of environmental protection according to the provisions of law. Other agencies, organizations and individuals related to administrative sanctions prescribed in this Resolution.
Accordingly, the fine for administrative violations prescribed in this Resolution is higher than the fine for corresponding administrative violations prescribed in Decree No. 45/2022/ND-CP, but does not exceed the fine prescribed in Point k, Clause 1, Article 24 of the Law on Handling of Administrative Violations, amended and supplemented at Point k, Clause 10, Article 1 of the Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations.
The competent authorities for sanctioning administrative violations prescribed in Decree No. 45/2022/ND-CP have the authority to sanction corresponding to the fine for violations prescribed in Article 5 of this Resolution. In case the Government adjusts regulations on the authority to handle administrative violations in the field of environmental protection, it shall comply with the Government's regulations.
According to the Resolution, the fine of double the fine for administrative violations prescribed in the articles, clauses and points of Decree No. 45/2022/ND-CP shall be applied. For organizations with the same violation, the fine is twice the fine for individuals.
Including acts under Clause 2, Article 25 of Decree No. 45/2022/ND-CP.
In Clause 2, Article 25 of Decree No. 45/2022/ND-CP, a fine of VND 150,000 - VND 250,000 for personal hygiene (small- amenities, heavy amenities) not specified in an apartment building, commercial area, service area or public place is imposed. Fines from VND 500,000 to VND 1 million for the act of dumping, discharging, discarding waste, or dumping wastewater in the wrong place in an apartment complex, commercial area, service area or public place...
Thus, according to the Resolution of the Hanoi People's Council, personal hygiene ( light and heavy) in the wrong place will be subject to a fine of 300,000 VND - 500,000 VND. The act of dumping, discharging, discarding waste, or dumping wastewater in the wrong place will be subject to a fine of 1 million VND - 2 million VND.
