In Vinh Long province, are children born before the age of 35 entitled to any benefits?".
Regarding this issue, Vinh Long Provincial Social Insurance answers as follows:
Based on Clauses 2, 3, 5, Article 50 of the 2024 Law on Social Insurance:
Article 50. Subjects and conditions for enjoying maternity benefits
... 2. Subjects specified in points b, c, d and d, clause 1 of this Article must pay compulsory social insurance for 06 months or more within 12 consecutive months before giving birth or receiving children when requesting surrogacy or adopting children under 06 months old.
3. Subjects specified in points b and c, clause 1 of this Article who have paid compulsory social insurance for 12 months or more and who have to take leave for maternity leave during pregnancy as prescribed by medical examination and treatment practitioners at medical examination and treatment facilities must pay compulsory social insurance for 03 months or more within the 12 consecutive months before giving birth.
... 5. Subjects specified in point b, clause 1 of this Article who have paid compulsory social insurance for 06 months or more within 24 consecutive months before giving birth for cases of having to quit their jobs for infertility treatment".
Thus, based on the above regulations in normal cases, Ms. N.A, if she has paid social insurance for 6 months or more within 12 consecutive months before giving birth, is eligible for maternity benefits.
In case of having to take maternity leave as prescribed by a medical examination and treatment practitioner, contributing to social insurance for a full 3 months within the 12-month period immediately preceding birth is eligible.
In case of having to quit for infertility treatment, social insurance contributions for 6 months or more within 24 consecutive months before birth are eligible.
Regarding the regime of having children before the age of 35 in Vinh Long province, it is proposed that she contact the people's committees of the commune and ward where she resides for specific guidance.
