Lawyer Nguyen Thu Trang, Deputy Director of Heva Law Company Limited, said that currently, functional agencies are proposing to amend Decree No. 168/2024/ND-CP. According to the draft (second time), the penalty level for motorbike insurance is not mentioned.

Currently, motorbike insurance fines are adjusted according to Decree No. 168/2024/ND-CP, effective from January 1, 2025. This Decree stipulates penalties for the offense of not having motorbike insurance or expired motorbike insurance. Details are as follows:

Point a, point b Clause 2 Article 18 of Decree 168 stipulates penalties and deductions from driver's license points for violations of regulations on the conditions of motor vehicle drivers as follows: A fine of between 200,000 VND and 300,000 VND shall be imposed for one of the following violations:

Drivers of motorbikes, mopeds (motorbikes), similar types of motorbikes and similar types of motorbikes engaged in transportation business who do not carry the valid compulsory civil liability insurance certificate of the motor vehicle owner.

Drivers of motorbikes, mopeds, similar types of motorbikes and similar types of mopeds who do not have a valid compulsory civil liability insurance certificate of the motor vehicle owner.

Thus, according to current regulations, civil liability insurance for motor vehicles (including motorbike insurance) is still a mandatory type of insurance. If there is no motorbike insurance or insurance expires, motorbike drivers will be fined from 200,000 to 300,000 VND according to Decree 168.
