The Ministry of Public Security is seeking comments until October 1, 2024 on the Draft Decree regulating administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points, restoration of points on driving licenses.
Article 39 of the draft stipulates penalties for violations of regulations on technical safety inspection and environmental protection of motor vehicles.
Accordingly, the authorities will impose a fine of VND 8,000,000 to VND 12,000,000 on the Inspection Center that commits one of the following violations:
Conduct inspection when the status of inspection equipment and tools has not been confirmed or the confirmation is no longer valid to ensure accuracy according to regulations.
Conduct inspection when the condition of the inspection equipment and tools is damaged and does not ensure accuracy according to regulations.
Failure to conduct inspection and control of the inspection process and inspection results as prescribed.
Failure to retain inspection data as required.
A fine of VND 5,000,000 to VND 7,000,000 shall be imposed on a Vehicle Inspection Centre that commits one of the following violations:
Not publicly disclosing inspection procedures and processes at the unit's headquarters as prescribed.
Failure to conduct vehicle inspection in accordance with assigned authority.
Using inspectors and professional staff who do not meet the required qualifications.
Conducting inspections without ensuring adequate inspection equipment, tools, and labor protection as prescribed.
Not having enough minimum number of inspectors on the inspection line.
Conduct inspection and issue inspection certificates exceeding the number of vehicles prescribed for each inspection line.
A fine of 1,000,000 VND to 2,000,000 VND shall be imposed on vehicle inspectors and professional staff of the Vehicle Inspection Center who commit one of the following violations:
Falsify test results.
Failure to comply with regulations in relevant technical procedures and standards in inspection.
Failure to perform assigned tasks.
In addition to being fined, individuals and organizations committing certain violations will also be subject to additional penalties such as having their vehicle inspection certificates revoked for a period of 1 to 3 months.
