Mr. Le Duc Thang - a fruit seller at the unit market in Hanoi - said: "Workers like us often use old motorbikes. Therefore, we are very worried, when checking motorbike emissions, we do not know whether these vehicles can be used anymore or not?".
Mr. Pham The Thieu - a used motorbike trader in Cau Giay - said that from the beginning of 2025 until now, he has been importing goods at a low level because he has to wait for the official roadmap for motorbike emission inspection to be issued.
According to the reporter's update, the Government has not yet issued a roadmap for applying emissions from motorbikes in circulation. However, a legal corridor related to motorbike emissions has been built.
Clause 1, 2, Article 27 of Circular 47/2024/TT-BGTVT stipulates that motorbikes with a time from the year of manufacture of more than 5 years must be brought to the inspection facility for emission inspection.
For motorbikes with a manufacturing year to 5 years, the owner does not have to submit an emission inspection dossier and does not have to bring the vehicle to the inspection facility for emission inspection.
The emission inspection certificate for motorbikes is issued by the Vietnam Register on the inspection management software based on the results of the certification of technical safety and environmental protection quality in the production, assembly and import of motorbikes taken from the archived data of the Vietnam Register combined with the database on registration and management of motor vehicles of the Ministry of Public Security.
Procedures for motorcycle emission inspection are as follows:
Step 1: Bring the vehicle to the inspection agency for emission inspection.
Step 2: The vehicle owner must present one of the following documents:
Original vehicle registration certificate.
Certified copy or a certified electronic copy of the original vehicle registration certificate.
Original appointment letter for issuance of vehicle registration certificate.
Step 3: The facility inspects the dossier and inspects the emission.
Inspection facilities receive documents, look up information of motorbikes on inspection management software and compare actual motorbike registration certificates:
In case the vehicle is refused inspection, the inspection facility shall make a notice and send it to the vehicle owner.
In case the vehicle is not subject to inspection refusal, a certificate of inspection shall be issued.
In case of direct submission of documents: The inspection facility conducts an emission inspection on the same day of receiving the complete documents. If the inspection results do not meet the requirements, the inspection facility shall prepare a notice and send it to the vehicle owner; in case the results meet the requirements, the inspection facility shall issue an emission inspection certificate according to the validity period of the emission inspection certificate for motorbikes.
In case of submitting the application online: The inspection facility confirms the emission inspection appointment and notifies the vehicle owner about the time to conduct the motorbike emission inspection. When the vehicle owner brings the motorbike, the inspection facility conducts the emission inspection on the same day.
If the inspection results do not meet the requirements, the inspection facility will prepare a notice and send it to the vehicle owner.
If the results meet the requirements, the inspection facility shall issue an emission inspection certificate according to the validity period of the emission inspection certificate for motorbikes.
Step 4: Issuing an emission inspection certificate for motorbikes.
The emission inspection certificate issued for motorbikes is an electronic copy integrated with data with the vehicle owner's electronic identification account, specifically as follows:
Certificate of initial emission inspection of motorbikes according to form No. 04 of Appendix XX issued with this Circular.
Certificate of periodic emission inspection of motorbikes according to form No. 05 of Appendix XX issued with this Circular.
Not only regulating procedures, Decree No. 168/2024/ND-CP stipulates penalties for failure to inspect motorbike emissions.
Accordingly, Decree 168 stipulates a fine of VND 200,000 to VND 300,000 for individuals and VND 400,000 to VND 600,000 for organizations that are motorbike owners who commit one of the following violations:
Bring a vehicle without a motorbike emission inspection certificate or one that has expired or used a motorbike emission inspection certificate not issued by a competent authority.
Although there are regulations on fines for motorbike emission inspection, this regulation will not be implemented from January 1, 2025.
Clause 2, Article 53 of Decree 168 (effective) stipulates as follows: This regulation takes effect in accordance with the provisions of the law on environmental protection on motorbike emission inspection.
