Regulations on motorcycle emission inspection in the law

Motorcycle emission testing is a new content in the Law on Road Traffic Safety and Order.

Article 42 of the Law on Road Traffic Safety and Order on ensuring technical safety and environmental protection of motor vehicles and specialized motorbikes participating in road traffic is as follows:

Motor vehicles and specialized motorbikes participating in road traffic must be inspected according to the provisions of law.

Motorcycle inspection only includes emission inspection. Motorcycle emission inspection is carried out in accordance with environmental protection laws and is carried out at emission inspection facilities that meet national technical standards.

Motor vehicles and specialized motorbikes with a certificate of technical safety and environmental protection from a vehicle inspection facility or a certificate of factory inspection from the manufacturer are not required to be inspected when moving from a border gate, place of production or assembly to a warehouse, port or store or vice versa.

The technical safety and environmental protection inspection of motor vehicles and specialized motorbikes is carried out by inspectors of the inspection facility and the inspection facility issues an inspection certificate.

The Minister of Transport prescribes the following content:

Procedures for granting new, re-granting, temporarily suspending operations, and revoking certificates of eligibility for motor vehicle inspection operations of motor vehicle inspection facilities;

Procedures for granting new, re-granting, temporarily suspending operations, and revoking certificates of eligibility to operate for facilities testing emissions of motorbikes and scooters;

Procedures for certification of technical safety and environmental protection for modified motor vehicles and modified special-purpose motorbikes;

Procedures for inspection and exemption from first-time inspection for motor vehicles and specialized motorbikes;

Procedures for inspection of emissions of motorbikes and scooters;

National technical regulations on technical facilities and locations of motor vehicle inspection facilities, motorcycle and motorbike emission inspection facilities; national technical regulations on motor vehicles and specialized motorcycles participating in road traffic;

Size and load limits for motor vehicles and specialized motorbikes participating in road traffic;

Technical requirements for motor vehicles and specialized motorbikes subject to research and development that need to participate in road traffic.

The Minister of National Defense and the Minister of Public Security shall prescribe the procedures for technical safety and environmental protection inspection of motor vehicles and specialized motorbikes, and certification of technical safety and environmental protection quality of converted motor vehicles and modified specialized motorbikes under the management of the Ministry of National Defense and the Ministry of Public Security.

Regarding the roadmap for motorbike emission inspection, previously, the Ministry of Transport said that emission inspection for motorbikes in circulation is not mandatory from January 1, 2025 but is carried out according to the Prime Minister's Decision stipulating the roadmap for applying emissions of road motor vehicles in circulation (roadmap).

Currently, the Government is still researching a roadmap to apply emission testing for motorbikes in circulation.

Although motorcycle emission testing has not been applied immediately from January 1, 2025, in order to avoid congestion at emission testing facilities, the Ministry of Transport has proactively developed relevant legal documents to prepare for motorcycle emission testing as follows:

Submit to the Government for promulgation a Decree regulating the business conditions of motor vehicle inspection services; organization and operation of inspection facilities; and the life span of motor vehicles. Including regulations on the operating conditions of facilities for inspection of emissions of motorbikes and mopeds.

Issue 03 Circulars under authority:

Circular regulating the procedures for granting new, re-granting, temporarily suspending operations, and revoking certificates of eligibility for motor vehicle inspection activities of motor vehicle inspection establishments and motorcycle and motorbike emission inspection establishments.

Circular regulating the order and procedures for inspection and exemption from first-time inspection for motor vehicles and specialized motorbikes; the order and procedures for certification of technical safety and environmental protection for converted motor vehicles and modified specialized motorbikes; the order and procedures for inspection of exhaust emissions of motorbikes and mopeds.

Circular promulgating National technical regulations on technical facilities and locations of motor vehicle inspection facilities, and motorcycle and motorbike emission inspection facilities.

In the coming time, the Ministry of Transport will closely coordinate with the Ministry of Natural Resources and Environment to complete the Roadmap to submit to the Prime Minister; at the same time, carry out propaganda, dissemination, and organize training for inspectors, professional staff, etc. so that agencies, organizations, and enterprises have time to prepare technical facilities and human resources to reduce possible congestion at inspection facilities.
