From 2025, will motorbike insurance still be mandatory?
Reader Cao Van Son (Cau Giay, Hanoi): From January 1, 2025, when the Law on Road Traffic Order and Safety 2024 comes into effect, will people have to buy motorbike insurance?
The lawyer said that based on the provisions of Clause 1, Article 56 of the Law on Road Traffic Order and Safety 2024, there are regulations on the conditions for drivers participating in road traffic as follows:
Conditions for drivers participating in road traffic
Drivers participating in road traffic must be of legal age and health; have a valid driving license with points remaining, appropriate to the type of vehicle being driven, issued by a competent authority, except for motorbike drivers specified in Clause 4 of this Article. When participating in road traffic, drivers must carry the following documents:
Vehicle registration certificate or certified copy of Vehicle registration certificate with original confirmation documents from a valid credit institution or foreign bank branch in case the vehicle is mortgaged at a credit institution or foreign bank branch.
Driving license appropriate to the type of vehicle being driven.
Certificate of technical safety and environmental protection inspection for motor vehicles according to the provisions of law.
Certificate of compulsory civil liability insurance of motor vehicle owners.
According to the above regulations, it can be seen that among the types of documents that traffic participants are required to carry from January 1, 2025, there is still a Certificate of compulsory civil liability insurance of motor vehicle owners as currently applied regulations (Article 58 of the 2008 Road Traffic Law, valid until December 31, 2024).
Therefore, from January 1, 2025, people participating in traffic are still required to have motorbike insurance.
Will I be fined for not carrying insurance?
According to Article 58 of the 2008 Road Traffic Law, the conditions for drivers participating in traffic are as follows:
- Drivers participating in traffic must be of the age and health specified in Article 60 of the 2008 Road Traffic Law and have a driver's license appropriate to the type of vehicle they are allowed to drive, issued by a competent state agency.
- When driving a vehicle, the driver must carry the following documents: Vehicle registration. Driving license for motor vehicle drivers as prescribed in Article 59 of this Law. Certificate of technical safety and environmental protection inspection for motor vehicles as prescribed in Article 55 of the 2008 Road Traffic Law. Certificate of civil liability insurance of the motor vehicle owner.
At the same time, at Point a, Clause 2, Article 21 of Decree 100/2019/ND-CP, amended by Clause 11, Article 2 of Decree 123/2021/ND-CP, drivers of motorbikes, mopeds, motorbike-like vehicles and moped-like vehicles who do not have or do not carry valid motorbike insurance will be fined from VND 100,000 to VND 200,000.
