Mr. Nguyen Van Hung (character's name has been changed) said that he has worked in the land sector at a private enterprise for nearly 10 years, including about 2 years as a contract worker at the Department of Natural Resources and Environment before moving to the enterprise sector.
Currently, he hopes to work as a commune-level civil servant in the field of Land Management.
According to Mr. Hung, through researching the provisions of Article 13 of Decree 170/2025/ND-CP, he has not found any content that clearly mentions his case.
Therefore, he suggested clarifying whether he is eligible to be considered for admission to work as a civil servant in the commune, what is the form of admission applied in this case, as well as the procedures that need to be carried out to be accepted in accordance with regulations.
Regarding Mr. Hung's petition, the Ministry of Home Affairs responded on the Electronic Information Portal.
The Ministry of Home Affairs said that according to the provisions of Point b, Clause 3, Article 13 of Decree No. 170/2025/ND-CP, in the cases specified in Points b, c, d, e, g and h, Clause 1 of this Article, if there are 5 years or more of work in accordance with the provisions of law, and there is a compulsory social insurance payment (not including probationary and probationary period, if not continuous and have not received a one-time social insurance subsidy, then it will be accumulated, including the working time if there was before in the job position specified in Points b, c, d, dd, e, g and h, Clause 1 of this Article), doing a job with professional qualifications and skills requirements suitable for the job in the expected job position, it will be considered and accepted as a civil servant.
Thus, in the case of civil servants accepted into civil service in the job position of a specialist, they must have a university degree of 5 years or more and do a job that requires professional qualifications and skills suitable for the job position expected to be received.
The Ministry of Home Affairs recommends that citizens contact local authorities for guidance and implementation according to regulations.
