Ms. Pham Thi Huyen (character's name has been changed) said that she has worked for 14 years and 6 months in her current position, including 11 years in the cadre position and 4 years and 6 months in the specialist position. She also said that she has had a university degree since 2017.
From this information, Ms. Huyen questioned whether, according to the provisions of Point b, Clause 3, Article 13, Decree No. 170/2025/ND-CP of the Government, she is eligible to be accepted as a civil servant in the specialist rank.
Regarding Ms. Huyen's petition, the Ministry of Home Affairs responded on the Electronic Information Portal.
According to the provisions of Point b, Clause 3, Article 13, Decree No. 170/2025/ND-CP, in the case specified in Points b, c, d, e, g and h, Clause 1 of this Article, if there are 5 years or more of work in accordance with the provisions of law, and there is compulsory social insurance payment (not including probationary and probationary period, if not continuous and not receiving one-time social insurance benefits, then it will be accumulated, including the working time if there was before at the job position specified in Points b, c, d, dd, e, g and h, Clause 1 of this Article), doing a job with professional qualifications and skills requirements suitable for the job in the expected job position, it will be considered and accepted as a civil servant.
Thus, in the case of civil servants accepted into civil service in the job position of a specialist, they must have a university degree of 5 years or more and do a job that requires professional qualifications and skills suitable for the job position expected to be received.
The Ministry of Home Affairs recommends that citizens contact local authorities for guidance and implementation according to regulations.
