Ms. Nguyen Thi Thuy (character's name has been changed) questioned at point g, clause 1, Article 13 of Decree 170/2025/ND-CP stipulating standards and conditions for the application for admission to civil service for non-professional workers at the commune level; at the same time, Clause b, Clause 3, Article 13 requires having worked for 5 years or more.
Therefore, she proposed to clarify whether the time to calculate the full 5 years is the time to submit the application or before the effective date of the Decree (June 30, 2025).
Regarding Ms. Thuy's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government regulating the recruitment, use and management of civil servants takes effect from July 1, 2025, so the consideration and acceptance of civil servants as prescribed in Articles 13 and 14 of Decree No. 170/2025/ND-CP is implemented from July 1, 2025.
In particular, the subjects of receipt are clearly stipulated in Article 13 of the Decree, including:
Experts, scientists, lawyers, good lawyers, outstanding and outstanding businessmen working at agencies, organizations, and units outside the public sector according to policies to attract talented people;
Officials working at public service units;
Salary earners in the People's Army, People's Public Security, or key organizations who are not civil servants;
People holding leadership or management positions and titles from department level or higher at enterprises with 100% state capital or at enterprises with more than 50% state capital or total voting shares;
A person who was a cadre or civil servant and was then transferred or rotated by competent authorities to hold positions other than a cadre or civil servant at other agencies or organizations;
People recruited according to the staffing quota assigned by competent authorities to work in associations assigned by the Party and the State;
Part-time workers at the commune level before the effective date of this Decree;
Members of the pilot project to select young volunteer intellectuals to participate in rural and mountainous development in the period of 2013 - 2020 to register for labor contracts to work in the commune (before July 1, 2025) to work in the commune (from July 1, 2025).
