The Ministry of Home Affairs received a petition from voters in Quang Ngai province sent by the National Assembly's Petition and Supervision Committee under Official Dispatch No. 1691/UBDNGS15.
Accordingly, voters in Quang Ngai province stated that currently, in many localities, the team of non-professional workers at the commune level has a number of students who are eligible for admission and have graduated from university according to the State's policy, returning to work and work at commune government agencies.
This force is mostly young cadres, with professional qualifications, knowledge of the area and the desire to stay with the facility for a long time.
However, according to the provisions of Decree No. 170/2025/ND-CP of the Government on recruitment, use and management of civil servants, these subjects have not had enough working time of more than 5 years, so they have not been considered and arranged in the payroll of commune-level civil servants.
This regulation partly causes difficulties, affecting the psychology and working motivation of the recruiting team.
Quang Ngai voters propose that the Government direct the Ministry of Home Affairs and relevant agencies to study and issue specific mechanisms and policies to prioritize the consideration of the arrangement of commune-level civil servant positions for non-professional workers subject to selection;
At the same time, consider shortening or flexibly applying the working time conditions prescribed in Decree No. 170/2025/ND-CP for mountainous areas, remote areas, and areas with special difficulties; thereby creating conditions for this team to stabilize their work and continue to contribute to state management at the grassroots level.
Regarding this issue, the Ministry of Home Affairs has issued Document No. 11355 in response to the National Assembly Delegation of Quang Ngai province.
According to the Ministry of Home Affairs, based on the Law on Cadres and Civil Servants in 2025, the Government issued Decree No. 170/2025/ND-CP dated June 30, 2025 regulating the recruitment, use and management of civil servants. In which, Clause 2, Article 5 stipulates the case of students under the recruitment regime according to the provisions of the Law on Education, after graduating and returning to work in the locality where they are sent to study, they are considered for admission to work as civil servants and Article 13 stipulates the subjects, standards, conditions, and documents for admission to work as civil servants.
On August 31, 2025, the Ministry of Home Affairs issued Official Letter No. 7415/BNV-CCVC on the personnel assurance plan at the commune level.
Accordingly, the Ministry of Home Affairs requests the Provincial People's Committee to base on the provisions of Decree No. 170/2025/ND-CP and the instructions of the Ministry of Home Affairs mentioned above to consider and recruit subjects to work as civil servants in accordance with the actual situation of the locality.
