On the Government Portal, Mr. N.V.T in Bac Ninh said that he applied for a license to level the ground of about 400 m2 to build a house on residential land with a total expected volume of 700 m3 of floating land.
According to the dossier form, there are: (1) maps of the location of the mineral recovery area; (2) maps, drawings, geological and mineral charts of the mine area; (3) maps of the current status of the recovery area; (4) maps of the mineral recovery area; (5) maps of the general site of the entire mine area.
Mr. T found that the above documents are for large-scale mining, while for people, if they are hired to draw maps and designs like his, the cost is about 10-20 million VND and there are no instructions for drawing maps.
Mr. T asked, how are people doing the leveling to build houses (not exploiting minerals for sale or for any other purpose)?
The Ministry of Agriculture and Environment responds to this issue as follows:
Form No. 04 in the Appendix of the Guiding Circular No. 36/2025/TT-BNNMT dated July 2, 2025 as mentioned in the content of his question is applied to the case of mineral recovery in the area of a mineral exploitation investment project.
In his case, the land user who renovates and constructs works on residential land and agricultural land is allowed to recover group III and group IV minerals from the renovation and construction of works on residential land and agricultural land as prescribed in Point d, Clause 1, Article 75 of the Law on Geology and Minerals.
The form of mineral recovery registration in this case is specifically regulated in Form No. 03 of Appendix III of Circular No. 36/2025/TT-BNNMT dated July 2, 2025 of the Minister of Agriculture and Environment regulating mineral exploitation, mineral exploitation and mineral recovery.
