On the afternoon of July 29, the National Assembly Standing Committee gave opinions on the draft Law on Real Estate Business (amended).
Presenting the Government's report, Member of the Party Central Committee, Minister of Construction Tran Hong Minh said that this draft Law is being studied for amendment based on inheriting the contents stipulated in the Real Estate Business Law in 2023.
The draft amended law stipulates the authority to decide to allow the transfer of the entire or part of real estate projects in the direction of transferring authority from the Prime Minister to the Provincial People's Committee.
Along with that, the draft cuts 1 condition on the procedure for prior notice of sale and lease-purchase of the floor area formed in the future.

Cutting 3 procedures for issuing new and re-issuing operating licenses of real estate exchanges.
The draft focuses on amending and supplementing regulations to remove difficulties and obstacles arising in practice.
Supplementing types of houses for residential purposes, commercial housing at appropriate prices according to the provisions of housing law; amending and supplementing regulations on real estate business contracts in the direction of expanding types of transfer contracts.
Regulating some minimum contents of the contract and clarifying the principles of application, reviewing, and being consistent with the law on protection of consumer rights.
The draft also amends and supplements regulations on building information systems and databases on housing and the real estate market in the direction of ensuring that data is created and updated correctly, fully, cleanly, and vividly.
Regarding the new additional contents, the Minister of Construction said that the draft supplements the real estate transaction process; supplements regulations on fulfilling financial obligations for BT projects according to new regulations of law on public-private partnership investment.

Reporting the opinions of the thẩm tra agency, Member of the Party Central Committee, Chairman of the Economic and Finance Committee Phan Van Mai said that the Standing Committee of this Committee agreed with the necessity to amend the Law on Real Estate Business.

The Chairman of the Economic and Financial Committee proposed to review the supplementation of house products for accommodation purposes, tourist apartments, office-combined apartments and the floor area of construction into the scope of real estate for business. Ensure uniformity between the law on land, housing and real estate business.
Regarding the types of contracts to be transferred, the Standing Committee of the thẩm tra agency proposed to supplement reports, explanations, and clarify the practical basis of the proposal to expand the scope of contracts to be transferred, including contracts for buying and selling existing houses but without Certificates.
Concluding on this content, Member of the Party Central Committee, Vice Chairman of the National Assembly Nguyen Hong Dien proposed to continue to study and review to comprehensively amend the Real Estate Business Law.
The Vice Chairman of the National Assembly noted that it is necessary to improve regulations on payment and guarantee mechanisms for real estate formed in the future, ensuring the legitimate rights of buyers and lease-purchasers.
Comprehensively assess the expansion of the scope of contracts to be transferred, conditions, procedures, responsibility for confirmation, information disclosure, and control mechanisms to prevent speculation, market manipulation, and pushing up real estate prices.
