The Ministry of Construction responds to regulations on paperwork types when implementing a 29-hectare project

    The Ministry of Construction has just responded to citizens' questions about the regulations on the type of documents when implementing a project of 29 hectares, with an investment of 150 billion.

    On the Government Information Portal, Mr. N.H.T in Gia Lai asked whether the pig farm project (level IV, total investment of 150 billion VND) is required to appraise the Feasibility Study Report of the construction expertise agency or not?

    Mr. T added that this project is being implemented with an area of 29 hectares (concentrated livestock land has been granted a red book; investing in items of level III houses (guard house, employee parking lot, operator's house, workers' housing, water tower, pig house, 630KVA transformer station...); has approved the environmental impact assessment report; the total estimated investment is over 150 billion VND, using other capital.

    The Ministry of Construction responds to this issue as follows:

    Clause 4, Article 11 of Decree No. 144/2025/ND-CP dated June 12, 2025 of the Government on decentralization and delegation of authority in the field of state management of the Ministry of Construction stipulates:

    "The specialized construction agency shall appraise the feasibility study report for construction investment and construction design after implementation according to the basic design prescribed in Point c, Point d, Clause 2, Article 16, Point c, Point d, Clause 1, Article 44 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government for projects with works having a great impact on safety and community benefits on the list in Appendix III issued with this Decree".

    At point d, clause 2, Article 16 of Decree No. 175/2024/ND-CP, it is stipulated that the authority to appraise the Construction Investment Feasibility Study Report of a specialized construction agency:

    "For the remaining projects, except for projects that only need to prepare an economic - technical report on construction investment according to the provisions of Clause 3, Article 5 of this Decree, the specialized construction agency under the management specialization prescribed in Article 121 of this Decree shall appraise the Construction Investment Feasibility Study Report for:

    Large-scale projects specified in Clause 6, Article 3 of this Decree, projects with works that have a great impact on safety and the benefits of communities using other capital".

    Accordingly, Mr. N.H.T, based on the above regulations, implemented compliance with the regulations.
