According to Official Dispatch 511/C06-TTDLDC in 2026 of the Ministry of Public Security, the confirmation of income conditions is implemented according to the provisions of Decree 261/2025/ND-CP of the Government.
Commune-level police at the place of permanent or temporary residence or current residence shall base information in the National Population Database to confirm income conditions for subjects specified in Clause 5, Article 76 of the Housing Law (low-income people in urban areas) in case there is no labor contract (according to Form No. 05 issued together with Circular 32/2025/TT-BXD dated November 10, 2025 amending and supplementing a number of articles of Circular No. 05/2024/TT-BXD dated July 31, 2024 of the Minister of Construction detailing a number of articles of the Housing Law).
However, currently, information about the income of subjects specified in Clause 5, Article 76 of the Housing Law in cases without labor contracts is not in the National Population Database system. Therefore, in the process of implementation, commune-level police encounter many difficulties and obstacles and do not have enough grounds to confirm this content.
Accordingly, to synchronously and uniformly implement the confirmation of income conditions according to the provisions of Clause 2, Article 1 of Decree No. 261/2025/ND-CP, the Ministry of Public Security requests local police to implement as follows:
1. The commune-level police can base on documents proving income provided by people (if any) to confirm income conditions for the implementation of social housing support policies.
In case people do not have documents to prove their income, it is requested that people commit to the content they have declared to the commune-level police.
On that basis, the commune-level police confirmed that people residing in the managed area have income declaration content according to Form No. 05 Download issued together with Circular 32/2025/TT-BXD amending and supplementing a number of articles of Circular 05/2024/TT-BXD detailing a number of articles of the Housing Law.
2. Local police direct and guide commune-level police to flexibly apply the above solutions to support confirming income conditions for people to the right subjects, in accordance with regulations, ensuring the legitimate rights of people, meeting professional requirements, preventing acts and cases of taking advantage of State policies for personal gain, affecting the security and order situation in the area.
