SunBay Park Ninh Thuan investor submits more than 170 billion VND after inspection

Khanh Hoa - The investor of the SunBay Park Hotel & Resort project has completed the payment of more than 170.9 billion VND in land use fees and late payment penalties to the state budget.

In December 2025, the Government Inspectorate issued an inspection conclusion for the SunBay Park Hotel & Resort project invested by SunBay Ninh Thuan Joint Stock Company.

According to the conclusion, the project was allocated land not in accordance with the plan, used the land for the wrong purpose and was slow to fulfill financial obligations according to regulations.

The Government Inspectorate determined that by the time of inspection (August 2025), the investor had not additionally paid more than 170.9 billion VND in land use fees and late payment penalties.

In which, land use fees accounted for more than 138.8 billion VND. The project has also not been completed according to the progress approved by competent authorities.

According to Lao Dong Newspaper's investigation, to date, SunBay Ninh Thuan Joint Stock Company has fully paid the amount of more than 170.9 billion VND as requested by the inspection agency.

This company also agreed and cooperated with functional agencies in recovering all 17 land use right certificates issued for the SunBay Park Hotel & Resort project to adjust the land use purpose and land use term, ensuring compliance with legal regulations.

According to Notice No. 3496/TB-TTCP dated December 29, 2025, the SunBay Park Hotel & Resort project was approved for investment policy by Ninh Thuan Provincial People's Committee from 2019 and adjusted in 2024.

The project aims to build a hotel and tourist apartment complex combined with commercial services in Binh Son coastal urban area, formerly belonging to My Binh ward, Phan Rang - Thap Cham city (old Ninh Thuan province), now belonging to Dong Hai ward, Khanh Hoa province.

The project has a land use area of more than 36,600m2, with a total investment of nearly 4,800 billion VND. However, the Government Inspectorate said that the project implementation progress to date has not fully met the requirements according to the approved dossier, and needs to continue to review and handle related shortcomings.

Notably, the Government Inspectorate determined that the Department of Natural Resources and Environment of Ninh Thuan province has issued 17 land use right certificates to investors with the purpose of use being urban residential land, with long-term use.

The issuance of these certificates is not in accordance with the detailed construction plan at a scale of 1/500 as well as the investment policy approved by the Provincial People's Committee.

According to legal documents, the entire land area implementing the Sunbay Park project is commercial and service land, without urban residential land.

The Government Inspectorate concluded that the issuance of land use right certificates for residential land purposes, for a long term, is not in accordance with the provisions of the 2013 Land Law, posing a risk of arising disputes, lawsuits and causing difficulties for state management of land.

From the above-mentioned shortcomings and violations, the Government Inspectorate determined that responsibility belongs to the Ninh Thuan Provincial People's Committee, the Ninh Thuan Provincial Department of Natural Resources and Environment, relevant organizations and individuals through each period and the project investor.
