On the Ministry of Construction Information Portal, citizen D.T.N reflected:
My Grade I project management certificate was issued by the Ministry of Construction. The investment project was approved in 2023, I was assigned to be the project management director in accordance with the requirements prescribed at the time of appointment.
However, by September 2025, my Grade I project management construction practice certificate expires.
Previously, the practicing certificate was issued by the Ministry of Construction. However, after implementing 2 levels by local authorities, the local Department of Construction has not yet approved the new issuance of a grade I practicing certificate.
I would like to ask, according to the provisions of Decree No. 175/2024/ND-CP, is it mandatory for individuals in charge of project management of projects as above to have a project management practicing certificate? I can continue to use the practicing certificate issued to be a project management director until the project is finalized.
During the period when the project management practice certificate expires, but I still perform the task of Project Director, is it a violation of the law and Decree No. 175/2024/ND-CP?".
After research, the Department of Economics - Construction Investment Management (Ministry of Construction) has the following opinions:
According to the provisions of Clause 3, Article 148 of the 2014 Construction Law amended and supplemented in Clause 53, Article 1 of Law No. 62/2020/QH14:
Titles and individuals engaged in construction activities that must have a practicing certificate according to the provisions of this Law include construction investment project management director; head, chairman of construction planning design; head of construction survey; head, chairman of construction design, construction design appraisal; construction supervision consultant; chairman of construction investment cost preparation, appraisal and management. Practicing certificates are classified into grades I, II and III".
In case the project management practice certificate of citizens expires, they are not eligible to hold the position of project management director according to the above regulations.
