Agricultural land needs to be valued closer to residential land in the same area

Voters propose to bring the value of agricultural land closer to the price of residential land in the same area according to each local characteristic.

The Ministry of Agriculture and Environment received a petition from voters in Lam Dong province with the content: Voters in Gia Hiep commune proposed that the Government direct to bring the value of agricultural land closer to the price of residential land in the same area according to each local characteristic.

Regarding this proposal, the Ministry of Agriculture and Environment would like to report as follows:

- Point a, point d, clause 1, Article 158 of the 2024 Land Law stipulates:

Article 158. Principles, bases, and methods of land valuation

1. Land valuation must ensure the following principles:

a) Land valuation method according to market principles;...

e) Ensuring harmony of interests between the State, land users and investors.

- Clause 3, Article 159 of the 2024 Land Law stipulates:

Article 159. Land price table

3. The Provincial People's Committee shall develop and submit to the People's Council of the same level for decision the first land price list for announcement and application from January 1, 2026. Every year, the Provincial People's Committee is responsible for submitting to the Provincial People's Council for decision on adjusting, amending, and supplementing the land price list for announcement and application from January 1 of the following year.

In case it is necessary to adjust, amend, or supplement the land price list during the year, the provincial-level People's Committee is responsible for submitting it to the provincial-level People's Council for decision. The provincial-level land management agency is responsible for assisting the provincial-level People's Committee in organizing the construction, adjustment, amendment, or supplementation of the land price list. In the process of implementation, the provincial-level land management agency is hired as a consulting organization to determine land prices for the construction, adjustment, amendment, and supplementation of the land price list".

- In Clause 11, Article 1, Point c, Clause 6, Article 7 of Decree No. 226/2025/ND-CP, abolishing Clause 2, Article 8 of Decree No. 151/2025/ND-CP, and at the same time amending and supplementing Clause 2, Article 20 of Decree No. 71/2024/ND-CP dated June 27, 2024 of the Government, regulations on land prices are as follows:

Article 1. Amending and supplementing a number of articles of Decree No. 71/2024/ND-CP dated June 27, 2024 of the Government regulating land prices 11. Amending and supplementing Clause 2, Article 20 as follows:

Based on the provisions of Clause 1 of this Article and the actual situation in the locality, the Provincial People's Council shall stipulate specific criteria for determining the location for each type of land, the number of land locations in the land price list at the same time as deciding the land price list. For land plots and land areas with favorable or unfavorable factors in land use, the Provincial People's Council shall base on the actual situation in the locality to stipulate increasing or decreasing prices for the following cases:

a) Commercial land, service land, non-agricultural production and business land that is not commercial or service land with high profitability, with advantages in the use of land as production, business, commercial and service grounds; agricultural land in residential areas, within the administrative boundaries of wards; agricultural land in the same land plot with houses;

b) Residential land plots with more favorable or less favorable factors affecting land prices compared to residential land plots with the same land location in the land price list.

- Clause 1, Article 12 of Decree No. 71/2024/ND-CP stipulates:

Article 12. Contents of building, adjusting, amending, and supplementing the land price list 1. Specifically regulating the prices of land types:

a) Price of annual crop land including rice land and other annual crop land;

b) Land prices for perennial crops;

c) Price of production forest land;

d) Land prices for aquaculture;

e) Land prices for salt production;...

n) Prices of other types of land according to land classification specified in Article 9 of the Land Law have not been specified from point a to point m of this clause according to local management requirements".

Based on the above-mentioned legal regulations, the regulation of land price lists for all types of land in the agricultural land group is the authority of the Provincial People's Council. Therefore, the Ministry requests the National Assembly Delegation and voters of Lam Dong province to have opinions and recommendations for the Provincial People's Council in the process of issuing land price lists to be consistent with the principles of land valuation and the specific situation in the locality.
