1. What is agricultural land fund?
Land fund is understood as land areas managed and used by ministries, branches, localities or state-owned enterprises.
This is the land area under the planning of competent State agencies, the local government where the land is located decides on the management, use and allocation of land funds in that locality. The land fund will be allocated to those who both have the need to use the land and can meet the prescribed conditions.
Based on the above understanding of land funds, it can be understood that the concept of "agricultural land fund" is the land used for agricultural production and cultivation purposes (cultivation, animal husbandry, etc.). This land is managed by ministries, branches, localities, enterprises, competent State agencies, and State-owned enterprises.
2. What are agricultural land funds I and II?
Current law has not yet provided a specific concept of “agricultural land fund I, fund II”. However, based on the understanding of land fund and agricultural land fund mentioned above, it can be understood that these are land plots used for agricultural purposes but not yet used.
Pursuant to Clause 4, Article 9 of the 2024 Land Law and Article 6 of Decree No. 102/2024/ND-CP, unused land is land whose purpose of use has not been determined and has not been assigned or leased, including:
- Land recovered by the State according to regulations but not yet assigned or leased for use, but assigned to the People's Committee at the commune level or a land fund development organization for management.
- Unused flat land: Is unused land in flat areas in plains, valleys, and plateaus.
- Unused hilly land: Is unused land on steep terrain in hilly and mountainous areas.
- Rocky mountain land without forests: Is unused land in the form of rocky mountains on which there are no forests.
- Unused land with water surface: Is land with water surface that has not been assigned, leased, or has an undetermined land use purpose.
Accordingly, agricultural land fund I and fund II can be simply understood as unused agricultural land, different from the type of agricultural land that has been put into use and has been allocated by the State to people for the purpose of agricultural production.
Unused agricultural land will be subject to the corresponding legal provisions governing the above issue.
