Promote decentralization and delegation of authority to localities to proactively handle headquarters after merger

According to experts, to effectively use headquarters and public assets after the merger, it is necessary to promote decentralization and delegation of authority to localities to proactively handle.

Promoting decentralization and delegation of power

Talking to Lao Dong Newspaper, Dr. Ta Dinh Hoa, Academy of Finance shared that localities are specific, so the needs for using headquarters after the merger will also be different. Therefore, to effectively use headquarters, the state only needs to build common legal corridors. The conversion of each headquarters should be assigned to local units, especially commune and ward-level units to proactively decide.

Dr. Ta Dinh Hoa also suggested that agency headquarters are public assets, so the conversion must still be prioritized for public use. However, the law can open up more mechanisms to convert to other purposes such as trade and services, applying strict synchronous conversion mechanisms such as bidding and auctioning to give localities more choices when converting.

Lawyer Nguyen Van Hau, Head of the Communications Agency of the Vietnam Bar Federation, shared that implementing the policy of merging administrative units nationwide will lead to a large number of redundant headquarters. Most of these headquarters are located in key areas with potential for local economic development if put into business exploitation. Therefore, if there are no caregivers or managers, the surplus facilities will quickly deteriorate, wasting public assets.

Lawyer Nguyen Van Hau added that with construction capital invested by the State, the exploitation of surplus facilities must ensure the principles of preserving and developing State capital as prescribed by law.

To be able to effectively implement the proposal to lease surplus headquarters, it is necessary to first ensure the removal of current legal problems, perfect regulations on management, lease and transfer of public assets, thereby creating favorable conditions for management agencies to have the right to officially put surplus assets into operation.

In particular, it is necessary to prioritize the application of leasing methods, limit the transfer or sale of public assets to non-state units, ensure that the State's ownership rights are not affected throughout the exploitation process.

The value of real estate or the value of real estate rental tends to increase. Therefore, it is necessary to preserve, not sell or minimize the sale of surplus headquarters, to promote the value of public assets in the long term.

For assets that have been seriously degraded or are no longer in accordance with the planning, management agencies need to prioritize the implementation of a recovery plan to quickly consider repairing, maintaining, and changing functions in accordance with the current situation, thereby continuing to put them into operation, avoiding waste of public assets.

Orientation of the Ministry of Finance

The Ministry of Finance said that the orientation of handling the working offices, the post -merged non -business operating establishments are as follows: Prioritizing the arrangement of working offices, non -business operating establishments of agencies, organizations and district -level units (after leaving the district level) to the grassroots administrative unit where the headquarters or agencies, organizations and other units of the State (including agencies, organizations and units are in need of central units. The unit can arrange a working office for many agencies, organizations and units using according to the management methods of Decree No. 151/2017/ND-CP.

Units shall exchange (transfer) headquarters and facilities for career activities between provincial, district, commune and central agencies in the area with surplus, excess, and missing areas compared to standards and norms to ensure maximum enjoyment of existing facilities, headquarters, and facilities for career activities in the area.

For headquarters and establishments of redundant non -business activities after arranging and arranging shall be carried out in accordance with the forms of handling properties in accordance with the law on the management and use of public property. In particular, priority is given to the conversion of functions as a medical, educational basis, used for other local public purposes (libraries, parks, cultural and sports institutions, etc.); Recovery for organization has the function of managing and trading local houses managing and exploiting (managing to serve the long -term goals of the State; preserving and protecting assets; arranging temporary agencies and units; leasing houses associated with land ...), assigning local land fund development organization management, development and exploitation in accordance with law.
