However, the law can open up more mechanisms to convert to other purposes such as trade and services, applying strict synchronous conversion mechanisms such as bidding and auctioning to give localities more choices when converting.
Lawyer Nguyen Van Hau, Head of the Communications Agency of the Vietnam Bar Federation, shared that implementing the policy of merging administrative units nationwide will lead to a large number of redundant headquarters. Most of these headquarters are located in key areas with potential for local economic development if put into business exploitation. Therefore, if there are no caregivers or managers, the surplus facilities will quickly deteriorate, wasting public assets.

To be able to effectively implement the proposal to lease surplus headquarters, it is necessary to first ensure the removal of current legal problems, perfect regulations on management, lease and transfer of public assets, thereby creating favorable conditions for management agencies to have the right to officially put surplus assets into operation.
In particular, it is necessary to prioritize the application of leasing methods, limit the transfer or sale of public assets to non-state units, ensure that the State's ownership rights are not affected throughout the exploitation process.
The value of real estate or the value of real estate rental tends to increase. Therefore, it is necessary to preserve, not sell or minimize the sale of surplus headquarters, to promote the value of public assets in the long term.
For assets that have been seriously degraded or are no longer in accordance with the planning, management agencies need to prioritize the implementation of a recovery plan to quickly consider repairing, maintaining, and changing functions in accordance with the current situation, thereby continuing to put them into operation, avoiding waste of public assets.
Orientation of the Ministry of Finance
