Citizens should send a question to the Ministry of Agriculture and Environment questioning the case of changing land use purposes to individual land users, after granting the certificate, does the Ward People's Committee have to hand over the land on site?
Responding to this question, the Ministry of Agriculture and Environment said that the order and procedures for allowing the conversion of land use purposes are implemented according to the provisions of Section I, Part III, Appendix I attached to Decree No. 151/2025/ND-CP; accordingly, in all cases, land users are allowed: The specialized agency on agriculture and environment must sign or submit to the competent authority to sign and issue a Certificate and perform the tasks specified in Clause 4, Article 228 of the Land Law; the handover of land on site is implemented according to Form No. 24 issued with this Decree.
Administrative procedures are implemented according to Section 1, Part B, Commune-level administrative procedures under the List of amended and supplemented administrative procedures under the management of the Ministry of Agriculture and Environment of Decision No. 3380/QD-BTNMT dated August 25, 2025 on newly issued administrative procedures, amended and supplemented the land sector under the state management of the Ministry of Agriculture and Environment.
Pursuant to the provisions of the above land law, the Ministry recommends that citizens contact the competent authorities on land management in the locality for consideration and resolution according to their authority.
