In October 2025, the People's Committee of Khanh Hoa province reported on the results and progress of the work to remove difficulties and obstacles for investment projects in the area.
In the report, the locality provided information related to the repair of the type of "residential land not forming residential units".
Khanh Hoa Provincial People's Committee said that the province has previously granted licenses to many real estate projects with land use purposes of trade and services.
However, due to the limited investment attraction situation, the Provincial Party Committee Standing Committee has agreed to allow investors to choose the form of land lease or land allocation with land use fees collected for a limited period of time for the service - tourism functional area, and long-term stable land allocation for the rental villa housing area (residential land not forming residential units).

Through the review, the Provincial People's Committee approved investment policies, planning and land for 53 projects in the form of "residential land not forming residential units".
To date, the province has issued a decision to remove this content from the legal documents of 38/53 projects.
The remaining 15 projects have arisen transactions with third parties, so it is not possible to remove the content of "residential land not forming residential units".
Of these, 10 projects have signed transfer contracts to secondary buyers and State agencies have issued 2,488 land use right certificates to buyers (including 241 cases that have signed contracts but have not been granted a book).
5 other projects have signed 1,955 transaction contracts, but secondary buyers have not been granted land use right certificates.
The reason the province cannot remove this regulation is because the above projects have had civil transactions.
If they are converted to commercial and service land with limited time, it will easily cause complaints and lawsuits.
On the other hand, the areas of these projects have not met the conditions for technical infrastructure and social infrastructure to be adjusted to residential land according to the law.
Therefore, to ensure the principle of not legalizing violations, the Provincial People's Committee does not have a legal basis to adjust planning into residential land, so these 15 projects do not meet the conditions for applying the provisions in Point d, Section 3 of the Appendix issued with Decision 93/QD-TTg dated September 12, 2024 of the Prime Minister.
Khanh Hoa Provincial People's Committee said that it has completed the repair and handling of 38/53 projects, and the remaining 15 projects will continue to be reviewed and reported to the Government Inspectorate and the Government Steering Committee 751.
The province is studying three groups of handling options, including: Adjusting to commercial and service land with a term of 50 years; Recognizing commercial and service land with a long term; Adjusting planning, changing the purpose to residential land (urban areas or mixed residential areas).
Each option is comprehensively assessed on legal impact, planning, finance - budget, social order and the rights of people and businesses, to ensure feasibility, harmony of interests and compliance with legal regulations.
After receiving instructions from competent authorities, the province will implement the next steps to completely resolve the problems and problems related to the type of residential land not forming residential units.
