The Ministry of Agriculture and Environment received a petition from voters in Ho Chi Minh City with the content: "Voters believe that the current Land Law and related documents still have problems and inadequacies in the implementation process, and have not prevented speculation, creating unreasonably high land prices. Therefore, it is recommended to study and issue a policy to stabilize land prices, avoid speculation and hoarding, increase prices that are not in accordance with reality, create conditions for people to easily access housing, contribute to settling down and stabilizing their lives".
Regarding this proposal, the Ministry of Agriculture and Environment reported to the National Assembly Delegation and voters of Ho Chi Minh City as follows:
To improve the effectiveness and efficiency of land management, healthy the real estate market, and promote socio-economic development, on August 21, 2024, the Prime Minister issued Official Dispatch No. 82/CD-TTg directing localities to promptly rectify land use rights auctions and has achieved certain results, gradually putting land use rights auctions into order, contributing to supplementing revenue for local budgets.
On December 14, 2024, the Prime Minister continued to issue Official Dispatch No. 134/CD-TTg on the rectification of land use rights auctions, in Section 3, assigning the Minister of Natural Resources and Environment (now the Ministry of Agriculture and Environment) to preside over and coordinate with the Ministers of the Ministries of Justice, Finance, Construction and Chairmen of People's Committees of provinces and centrally run cities to strengthen inspection and examination of land use rights auctions for cases with unusual signs, promptly detect shortcomings in legal regulations to advise and propose competent authorities to amend and supplement them appropriately; at the same time, handle according to authority or propose competent authorities to strictly handle organizations and individuals who violate the provisions of the law on land use rights auctions, especially land use rights auctions to cause market disruption.
Implementing the Prime Minister's Official Dispatch No. 03/CD-TTg dated January 15, 2025 on focusing on rectifying and handling price manipulation, real estate speculation and inspecting real estate construction investment projects, the Ministry of Agriculture and Environment has been continuing to actively coordinate with ministries, branches and localities to focus on implementing specific related tasks such as:
(1) Direct and coordinate with the People's Committees of provinces and centrally run cities to strengthen inspection, examination and review of land price determination activities, issuance of land price lists, compensation, site clearance, auction of land use rights... promptly rectify, prevent and strictly handle violations according to authority, especially acts of taking advantage of land use rights auctions for profit, causing market disruption.
(2) Coordinate with the Ministry of Construction and relevant ministries to research and implement digital transformation to connect procedures from real estate transactions, notarization, tax and land transaction registration in the electronic environment. In Official Dispatch No. 03/CD-TTg, the Prime Minister also directed the Ministry of Construction, the Ministry of Finance, the Governor of the State Bank of Vietnam, the Ministry of Public Security and the Chairman of the People's Committees of provinces and centrally run cities, according to their state management functions, to carry out specific tasks to strengthen control and stabilize the real estate market and real estate prices and promptly rectify and handle manipulation, price hike and real estate speculation.
Currently, the Ministry of Justice is presiding over and coordinating with the Ministry of Agriculture and Environment and relevant ministries and branches to draft a Government Resolution to remove obstacles in land use rights auctions, including the issue of participants in land auctions with unusually high bids showing signs of price manipulation, taking advantage of land auctions for profit and then " abandoning deposits", affecting the healthy development of the real estate market.
The Ministry of Agriculture and Environment has submitted to the National Assembly a Resolution stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, including regulations on land prices to ensure overcoming shortcomings and inadequacies in land prices in the past.
