Ms. N.T.T in Hanoi reflected that, according to the provisions of point c, clause 4, Article 109 of the Land Law, based on the annual land use plan of the district level (commune), the District People's Committee is responsible for preparing and organizing the implementation of training, career change and job search plans in the locality.
The above plan was developed and approved simultaneously with the compensation, support, and resettlement plan. However, in reality, Ms. T has not seen specific guidance on the order and method of building training, career change and job search plans.
Ms. T asked, is it after the working group conducts household inventory, fully identifying data related to land, assets, trees and population, that the People's Committee will base on that to develop a plan for training, career change and job search, in parallel with a compensation, support, and resettlement plan?
Regarding this issue, the Ministry of Agriculture and Environment answers as follows:
In Article 87 of the 2024 Land Law, Article 3 of Decree No. 88/2024/ND-CP dated July 15, 2024 of the Government stipulating compensation, support, and resettlement when the State recovers land (assigned authority in Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government) has stipulated the order and procedures for compensation, support, resettlement, and land recovery, including the following steps:
Meeting with land owners in the recovered area; Implementing the land recovery plan, investigation, survey, measurement, inventory (send Land Recovery Notice; measurement, inventory...).
Establishing, appraising, and approving compensation, support, and resettlement plans; Performing compensation, support, and resettlement tasks; Issuing land recovery decisions; Managing recovered land.
Point c, Clause 4, Article 109 of the Land Law (assigned authority in Decree No. 151/2025/ND-CP) has stipulated that the commune-level People's Committee is responsible for preparing and organizing the implementation of training, career change and job search plans in the locality. Training, career change and job search plans are prepared and approved simultaneously with compensation, support, and resettlement plans.
