The Office of the Ho Chi Minh City People's Committee has just announced the conclusion of Vice Chairman of the Ho Chi Minh City People's Committee Bui Xuan Cuong on cutting the procedures for granting construction permits for individual houses in areas with detailed planning at a scale of 1/500 (or general planning at a scale of 1/500 and architectural plans of works) approved or approved in accordance with regulations.
Vice Chairman of Ho Chi Minh City People's Committee Bui Xuan Cuong assigned the Department of Construction to announce (phase 1) a list of 112 projects that are eligible for exemption from construction permits according to the provisions of the law on construction.
According to the list, the old districts of Ho Chi Minh City such as: Thu Duc City has 41 projects, Nha Be 33 projects, Binh Chanh 17 projects, District 7 has 10 projects, Hoc Mon has 4 projects, District 12 has 3 projects, District 6 has 3 projects, and Can Gio has 1 project.
The Department of Construction is assigned to guide the People's Committees of relevant wards and communes in the list of 112 projects mentioned above to publicly post the list of projects eligible for exemption from construction permits.
In addition, localities will be updated with guiding documents of the Ministry of Construction and current legal regulations, especially related to the division of authority between the two levels of government in the construction sector. This is to ensure consistency in the process of guiding organizations and individuals to comply with the approved planning and carry out the construction initiation steps according to regulations when there is a notice of construction initiation.
The Vice Chairman of the Ho Chi Minh City People's Committee also assigned the Department of Construction to coordinate with relevant units to continue reviewing to announce the second phase on July 15, 2025.
At the same time, expand the review of other areas in Ho Chi Minh City such as Binh Duong, Ba Ria - Vung Tau (old) and Con Dao special zone, to announce more project categories and areas eligible for exemption from construction permits according to regulations.
The Ho Chi Minh City Department of Construction continues to be assigned to study and propose a model of simplifying construction licensing procedures, including a plan to exempt construction permits for individual houses in Ho Chi Minh City, based on local characteristics. The research results must be submitted to the City People's Committee before July 15, 2025.
Currently, the Government has issued Resolution No. 74/NQ-CP dated April 7, 2025 on the plan to reorganize administrative units and organize local governments at 2 levels. Ministries and branches are reviewing and adjusting the system of relevant legal documents.
On that basis, the Ho Chi Minh City Department of Construction is assigned to review and update the guiding documents of the Ministry of Construction and related documents to advise the Ho Chi Minh City People's Committee to issue a decision to adjust or replace Decision No. 56/2021/QD-UBND dated December 28, 2021 on promulgating the Regulations on Ho Chi Minh City Architecture Management.
The adjustment of this regulation aims to serve as a basis for simplifying licensing procedures or guiding the implementation of exemption of individual housing construction permits in the city.
Along with the reform of procedures, the Department of Construction will implement the digitization of all data related to construction licensing, including: technical drawings, legal documents, inspection minutes, related documents, etc. This is to enhance management and information lookup more conveniently, serve the inspection and monitoring of the licensing process and minimize errors in processing documents.
People and businesses will also be given the opportunity to submit documents online, shortening the time to handle administrative procedures.
